Hello,
I started a Trust Deed with Kelsom (Glasgow) in October 2012. During the trust deed, somehow my deed was transferred to Knightsbridge Insolvency (Manchester), I'm still not sure why this happened however I continued to make my payments to the new trustee. In December 2014 the trustee agreed to take a final payment from a family member to cover my final payments. Since then I am STILL waiting to be discharged. I have phoned numerous times and only got told that some of the creditors had not replied to the offer of monies being divided out by the trustee. Each time I phoned they said it would only be a couple of weeks before completion and my case was being prioritised. This is nearly 14 months ago since it was paid off and I haven't been discharged. Can anyone offer any advice what I should do or where I can complain. I am trying to move on with my life. Surely these things cant go on for that long?
Thank you
Welcome to the forum carlisle29.
This does seem like a very long time for this to take.
If you're dissatisfied you have the option of making a formal complaint to your trustee.
If you remain unhappy after this is responded to you can take the complaint to the professional body of which your trustee is a member.
Hello,
Thank you very much for the reply. I will write a letter of complaint to the trustee.
Hi carlisle29,
I don't think anyone should have to wait 14 months for their discharge from a Trust Deed if they have completed all of their payments and obligations.
It might be time to consider addressing the matter in writing to your Trustee. As TDA has advised you can complain to your Trustee and their authorising body if you are not satisfied.
I would pressure them on a daily/weekly basis for your discharge/Form 5.

I had the same issue with Knightsbridge and was continually lied to that it would only be another couple of weeks, this went on for about 3 months. I eventually gave them an ultimatum that if I didn't have my Form 5 by the following Friday then I would be writing a formal complaint and copying in the ombudsman etc.
I had a voicemail on the Thursday saying my Form 5 was in the post.
Don't get me wrong, I had to kick off a bit on the phone but the threats did work. My husband finishes his TD with Knightsbridge in March and we'll be on the phone to them every week to ensure the same thing doesn't happen again.
Good luck!
Hello
Thanks for the replies. I have sent a letter of complaint earlier this week which I will follow up with a phone call next week then progress to their authorising body.
We are in the same boat both myself and husband were transferred over to Knightsbridge and last TD payment made in Jan 2016. One individual stated our form 5 would be 6 weeks another individual stated 6months.......... Bit of a difference.
Persist on and hopefully you will receive it soon Carlisle29.

I was with Knightsbridge. No complaints at all over duration of the TD and they left me alone really. The discharge process was a pain though, took 8 months. Again, had to badger and complain which isn't a great place to be.
Hope it gets sorted for you soon.
The discharge process is one area where it can vary from firm to firm.
Some firms will discharge clients fairly quickly after their final payment and some firms can take months to do this.
We try to maintain a discharge period between 4-6 weeks from a client's final payment.
It's something which someone looking for debt advice should ask the firm and advisor they are speaking with as ultimately until that person is discharged any assets could vest with the Trustee.
It sounds like it's going to be persistence for you carlisle29 and Suzie28 to receive your discharge and From 5. Keep us up to date and let us know how you get on.

Again, thanks all for the replies. I will let you know how I get on. One thing i was thinking, with it taking so long to be discharged is will this effect how long it stays on my credit file or does it automatically come off after 6 years from starting it?
6 years from the date of default.
The date of default of each creditor should be the same as the Trust Deed Signing date.
If the dates different by more than a few weeks, you would need to contact each creditor to ask that they correct the date and mark as Satisfied or Partially Satisfied (when you have been discharged).
Good luck.
Thanks firewalker.
I have received confirmation of my complaint today. They have stated they will reply within 8 weeks! #128547;
Funnily enough, that's my form 5 came through the post today. I wish i had complained months ago.
Im going to have a look at my credit file soon to make sure its all recorded and up to date. Can anyone advise where is best to check? I did have an experian account but it was costing ยฃ15 per month and other than occasionally checking my credit score i wasn't getting anything from it
