hi all, my TD is still on the above.despite missing many payments owing to various reasons,I would be keen to restart payments but haven't had a reply from apex yet.
Anyone on here know if Nicola Boyd works with them?she was excellent to deal with.
or can I start a new TD from scratch with another company? any help from apex clients
would be appreciated.

Nicola Boyd doesn't work at Apex any longer, though there are plenty of other experienced case managers that do. I am sure that if you call them you will be able to sort this out and successfully complete your trust deed without having to start all over again.

Until you have been discharged by Apex your tied to them and cannot take steps yourself to enter into a Trust Deed or Sequestration with another company.

Without knowing the reasons for your missed payments It's difficult to say if another company would take you on as a client under a Trust Deed or Sequestration given you've missed many payments on your current Trust Deed.

Do you know how many payments you have missed and how many payments you would have outstanding to complete your Trust Deed? If you were to be discharged from the Trust Deed but not your debts and you wanted to enter into another Trust Deed or Sequestration this would start another 4 year payment period in a Trust Deed or 3 year payment period in a Sequestration.

You really need to try and speak with someone at Apex to clarify what their intentions are regarding your Trust Deed. I suspect with all the changes that have happened in the last couple of months your case may not have been top of their priority list due to the non payment issue. You may find that now things have settled down that you can get some progression on your case, recommence with payments and complete the Trust Deed.

hi all,many thanks for your input,been avoiding phoning them tbh,embarassed regarding missed payments etc.. emailed and sent a letter,but will now take all your helpful advice and phone them.thanks again.

one final question,i have just received letter from tax credits re substantial overpayment,can this be included in my td.if I can resume payments or would it be better to start td again if discharged? thanks

I think that's the right thing to do bankiedonnie. That way you're in touch with someone for sure and can start planning ahead.

Tax credit overpayments are an issue you'll want to discuss with your trustee. Are they seeking to recover this money through a reduction in your future tax credit payments? If so you'll need to let your trustee know so that it's factored into the amount that you pay into your trust deed (if your income is reduced).

hi tda thanks for your reply. no we don't have any to be recovered from future awards as we don't qualify now. all monies they want are from 2012/13,i signed my original td in feb 2011,but defaulted owing to work and health issues but started paying again in 2013 before stopping again owing to reasons stated above.

You may need to look to coming to an arrangement to repay the overpaid tax credits over time bankiedonnie.

They're not necessarily something that could be included in a new trust deed.
