Hi again,
I completed my Trust Deed in Jan 2015 after commencing in Sep 2011 and in Jan 2016 KPMG discharged themselves as matters were all concluded. A few months ago Prior to them discharging I spoke to KPMG in regard to some defaults still showing on my credit report from Bank of Scotland, Halifax and Barclaycard. They told me not to be concerned about that as it would all be sorted out by them.
I checked with Equifax today and I am still showing as being defaulted. Should I wait for matters to filter through onto my credit report or should I contact these companies directly?
Thanks for your help
Hi DontdoDebt
In my experience, the Trust Deed Companies do not correct your credit file. I think KPMG will be thinking when the dividend is paid to the Creditors they will correct the credit reference file, which is not always the case.
What is important to you is that the default date on the creditors file matches the signing date of the Trust Deed (or very soon after)
Mine ranged from a few weeks to six months out of synch.
The default showing on the creditor file will only be removed six years after the default date shown. So your Trust Deed would fall off, and yet some of the defaulted creditor files may still be showing if dates are incorrect.
There are four credit reference agency records to consider: Equifax, Experian, CallCredit and Noddle (part of CallCredit).
I had different information showing on different agencies.
I would suggest you contact each of the Creditors, provide them with a copy of your Form 5 which shows Signing of Trust Deed date and Discharge date, and ask that they correct the information as they are obliged to do under the Data Protection Act.
You can get Noddle report free of charge.
If you use Checkmyfile, you will get Equifax and CallCredit information (ยฃ7.99 per month)
Experian is around ยฃ15 per month.
As time went on I used Noddle and Callcredit to keep the monthly cost down.
While it is frustrating and you want it all to be sorted out ASAP, you have until 6 years after your Trust Deed signing to get them aligned and changed.
Hi Firewalker, thank you for your post I will contact the companies with a note on when the Trust Deed was signed up and my form 5 discharge as well. Hopefully I will get it cleared up. I suppose I will have to go through the same process with all the credit reference agencies as well, thanks again.
Hi DontDoDebt
The Credit reference agencies wont change your information on request. They report on the information given monthly by each lender.
You would only contact them if you had tried several times and could show them documented evidence that the creditor is not responding. Then they may agree to contact the creditor.
It is the responsibility of the Creditors/lenders to ensure all credit reference agency information is correct. However, you may want to check out what each credit reference agency has recorded against you. (example is that Equifax kept resurrecting a default from M&S I had when it was clear everywhere else - it was a system error - one speaking to the other).
The ICO (Information Commissioner Office - Data Protection) and the FCA (Financial Conduct Authority - kind of ruling body for lenders) are generally the people to refer to if you cannot get action ultimately.
Look at the turquoise buttons on the left of this site. Four up from the bottom is site information on Credit Report.
One step at a time, contact the lenders individually and see how you get on. Ask them to ensure all Credit Reference Agencies are updated.
That's a great help Firewalker and I appreciate all the info you've given me. I will get to it and make some calls!
PS: Your Form 5 Discharge will show both the signing date and the discharge date of the Trust Deed. Check it out.
Ah that's very helpful...! I will look it out!...thanks again Firewalker!...
