I made the last payment on my trust deed, which started in May 2008, at the end of Nov 2011. I have waited for my discharge letter as I was advised by the trustee's office that as soon as I made that contribution the closure process would commence. I contacted them to ask when i would be likely to receive my discharge letter only to be told by them that they were currently investigating a potential PPI claim (never mentioned to me throughout the life of my deed) and that they may extend my trust deed on this basis. I complained to them about this as I am extremely aggrieved that this would be investigated after I have reached the end of my deed. THey also mentioned new legislation which came into force at "the tail end of last year" regarding HMRC tax relief which they may be able to claim to pass on to my creditors also. All of this seems to be after my trust deed has been paid in full.
Any advice on this would be very much appreciated. I just want to wipe the slate clean now after the past few years and start repairing my credit file but am really disappointed that they are trying to drag things out even more. Surely any claims for PPI should have been investigated a lot earlier than now?

Please phone your IP and advise that even with the proposed PPI and changes to VAT, there is NOTHING to stop them discharging you while they remain in office to tidy up things. Refer them to the Protected Trust Deed Regulations as it is a post April 2008 Trust Deed.

Thank you for responding so quickly Mark...does this mean that on record I will be discharged from the deed and my credit file will thereafter follow suit? That's all im interested in really, they can try and claim whatever they like as long as I can start afresh on the credit front and try to repair the damage....light at the end of the tunnel would be good!!! ๐

Your trust deed firm are entitled to look into the possibility of PPI claims, more and more are starting to do so, but why so many are leaving it right to the very end, and frustrating clients that have done everything they were asked to do, is very hard to understand.
The VAT issue is a little different as trust deed firms have had to deal with this more recently than they could have considered looking into PPI claims.
We cannot tell you that your trust deed firm will discharge you. We can just tell you that because you signed after April 2008 there is nothing to stop them from discharging you while they carry on dealing with PPI and VAT issues. If they will not do this you'll need to decide between putting pressure on them or waiting patiently for them to complete the processes.

You wonder whether it would have been better just having been declared bankrupt...three years is a long time to have this hanging over you and then when you think you can start getting your life back on track they hit with more obstacles [:(!]...Ive sent them an email asking that they discharge me whilst tending to the issues by remaining in office, fingers crossed!!! Please don't get too "down" about this situation. You've done brilliantly to work through to the end of your trust deed and I'm sure the final discharge that you have earned isn't too far away.

Sorry I meant to say, the process is for the Trustee to issue Form 5 to you and to send a copy to the AIB for recording your discharge.
