Sequestration

Im just wondering if you were to file your own Sequestration would your employer be informed and would you have to close your bank account that your wages were being paid into? Im currently waiting on my trust deed becoming protected. My husband had a stroke in November hence the reason for the trust deed and he is on sick pay so he cannot enter one until he is back at work. He has 3 visas and an overdraft which we were going to put into his trust deed when he is viable. Unfortunatley the creditors he has are not very forth coming in accepting a reduced monthly contribution at present even though he has no spare income. I am aware that if we do not make payment and they send us default notice then he can Sequestrate himself but just read a post that you will loose your bank account? We have a joint bank account with the Nationwide would we have to close this?? Its where both our salarys are paid into and all our DD's come out of. Many thanks for any advice.

There would be no reason for your husbandÔÇÖs employer to find out. The only reason we would ever contact an employer is if the person wasnÔÇÖt co-operating or if there was a wages arrestment in place. As long as you donÔÇÖt have a debt with the bank that you hold your bank account with or you donÔÇÖt have an overdraft facility I would like to think that your account would be ok, particularly with the nationwide. Unfortunately all banks deal with this matter differently.
Just to clarify, your husband canÔÇÖt petition for his own bankruptcy with a default notice, it would need to be an expired charge for payment.
