Seperating during TD ?

My husband and I are nearing the end of our joint TD, however I think we will be seperating before it finishes. I just want to know if this changes anything ? I hope that I will stay in the house with our children, I dont work so I will probably get an increase in child tax credits payments, might the TD provider ask for any more money ? We have already paid the ยฃ500 thing for the house should there be any equity. And we only have one car which is mine that I was told shouldnt be a problem. Basically I need to know, can I get my husband to walk away with nothing, perhaps be living with his parents temporarily and just continue to pay his side of the TD until its finished ? Thanks

Welcome to the trust deed forum alphabet123.

If your circumstances change you should contact your trustee as they'll need to understand what these changes are.

This is important as it will ensure that:

A - You're not trying to make a payment that you cannot afford.

B - You're not paying less than you should be (in which case your protected trust deed might later be extended when this is discovered).

Your payment should continue to be calculated on the basis of affordability (income minus expenditure).

Your trustee shouldn't seek any payment from child tax credits, or indeed any means-tested benefit income, so I cannot see how this change would mean that you should have to pay any more than currently, alphabet123.
