My partners car has broken down twice over the weekend. This is the 3rd time within the last year it has broken down. We cannot afford to keep paying for the car to get fixed and were thinking of selling it and buying another, more reliable car with whatever we get for it. Would the trustee allow this?

Hi dm29.

I doubt that the Trustee will take issue with this assuming that there remains a reasonable need to have a vehicle.

Thanks TDA.

Do you know if they would want to get the car valued before we were to sell or would they be OK for us to sell the car, show them proof of the sale, how much we got for the car and a receipt for the new car?

Hi dm29.

They may do, but I'd imagine this is one of these questions where different trust deed providers handle things in different ways.

It may also depend a little on the value of the transactions.

Better safe than sorry - you should run it by your trustee first, but I don't see why they should have any problem with it.
