Hi
I made my last payment and was discharged on the 16/08/2017
I received notification that my trustee had sought and was granted discharge on the 31/08/2017.
However none of this was reflected on the Roi so after many phone calls to credit fix I am now showing that I have been discharged as of 22/05/2017 but still no trustee discharge how can I get this matter resolved ?

Hi happy01,

I'm a little confused by your dates as your saying its August 2017. Did you mean 2016?

Sorry I was discharged on the 16/08/2016 and my trustee on the 31/08/2016

Ah ok. Thanks for clarifying.

When you say you were discharged on the 18/08/16, did you receive your Form 5 then? Also when you say the Trustee was discharged on the 31/08/16 again where did you get this date from?

When it comes to your discharge this is official once it's registered with the Accountant in Bankruptcy. If Creditfix didn't send the paperwork until May 2017 then this will be your official discharge. It's down to Creditfix to send the paperwork and if there was a delay at their side then unfortunately the discharge date is when they lodged the paperwork and nothing can be done to change this.

Your best to give Creditfix a call tomorrow to ask them about this and why the dates are different.

I've been calling them for the past year ...initially re my form 5 which I eventually received and then about the entry on the Roi they sent me an email of form 7 and said they had sent the paperwork to the Roi and that they couldn't understand why it wasn't updated

It's hard for me to really say what has went wrong here.

Ultimately it's down to Creditfix to submit your discharge paperwork to the AIB. This is done electronically now via an online system so very rarely is there a problem.

How long did you have to chase to receive your Form 5 certificate or discharge?

If you have been calling them it's maybe a better idea to correspond in writing to ask what's happened.

i they said it would take up to 6 months for my last payment to when I would get my form 5 I called them for a further 3 months after that they kept changing the story as to why I hadn't received it took them another 2months ..they then said it had been sent and couldn't understand why I hadn't received it ...so they emailed it ...I called again before I got a posted form ..all in all it took 81/2 months for form 5 to land at my door

Sorry for the long replies ....when I eventually received my form 5 the date on it was 16/08/2016 ...I received it mid March

A shame that it took so long to arrive Happy01, but it's potentially to your benefit that it was dated in August 2016 rather than March this year.

Perhaps you might call the Accountant in Bankruptcy to query why the date they're showing on the official register is different?

If the trustee did not lodge the form 5 with the Accountant in Bankruptcy until 22 May 2017 then the date of discharge would be correctly stated on the ROI as this date as it is only when this happens that the discharge takes effect, regardless of when the form 5 was originally dated.

Thanks for the response contacted creditfix again ...it appears that no-one understands what's happening or why ..but again reassured that the matter will be dealt with urgently ..forgive me if I don't hold my breath #128514;
