Looking at the register the first entry is 1994, is this when the register was created? I thought that the record would drop off after 6 years (2007)
Will our detaild be permanently on this register now?
Hi on track.
My understanding is that it's taken off a year after discharge.
Hopefully one of our experts can confirm?
With the 1994 entry is there a discharge date for that case?
Six years relates to credit file entries.
The 'user guide' for the Register of Insolvencies says that
"Searches will return details of all ÔÇ£liveÔÇØ bankruptcy cases plus those that were discharged in the past two years. For protected trust deeds, returns will be made on ÔÇ£liveÔÇØ cases plus those discharged in the past year"
So, if a 1994 case is still on the Register, that suggests that one of the following must be the case:
- the bankruptcy is still "live"
- the bankruptcy has ended in the past two years (trustee discharged_
- there's been a mistake!
I think that the '6 years' timescale is to do with credit records - which is a different kettle of fish
If you go to the register of insolvencies and search all the entries ( using the* entry in the search boxes) the first entry is1994 but they follow on sequentially from there
Using that search technique, I found several cases from even earlier than 1994.
Having looked at a couple, the trustee was only discharged within the past year or so.
That means that those bankruptcies should still be on the Register.
The individuals, however, received their personal discharge from bankruptcy a long time ago.
It is quite possible for a trustee to be undischarged for many years in bankruptcy cases, as some cases can involve assets that cannot be realised for several years for whatever reason (eg properties with a liferent tenantetc). Presumably it is these cases that are showing up still despite being so old.
Wow, does an undischarged trustee have any impact on the individual going forward.
