Refusal of divorce based on finances

Hi,

My partner has been in a protected trust deed since April 14. He recently applied for a divorce based on 2 years separation, but his wife has refused it on the grounds of finances being settled.

My partner was under the impression that his finances were being taken care of through the trust deed, therefore his wife had no reason to refuse divorce? Their house is under repossession and has been for over 1year, this is included in my partners deed. Other than this, there is no joint debt.

Does she have a case?

I'm afraid this is a question for a lawyer rather than insolvency experts, Scorpio1. When it comes to divorce, financial matters are usually of a wider scope than just debt being dealt with in a Trust Deed.

As Kevin said it's something for a divorce lawyer to give clarification on.

If you do find out the position legally then it would be useful for you to let us know if you can.
