Refund after Trust Deed

I completed my trust deed in February 2015 and my trustee was discharged in February 2016, their discharge is noted on the AIB website. A payday loan company whose debt was included in my TD have contacted me today to advise that I am due to receive a refund due to "significant shortcomings" in their service which they are "working to remedy with the assistance of the FSA". Can I accept this refund given that my trust deed is discharged, or should this sum still be paid to the trustees? Thanks in advance for any assistance.

Hi Nina and welcome to the forum,

I can't see the Trustee looking to claim these funds as it is something which has arisen after the date of your discharge and also the Trustees.

There is a lot of talk at the moment about reopening Trust Deed's for PPI but I don't think that this falls into the same category.

To be sure you may want to give your Trustee a call and confirm this with them. That way you can spend the funds without worrying.

To be honest I don't really see how this is essentially different from PPi refunds, so it is possible that your Trustee might seek to be reappointed to gather in these funds, Nina. It might depend on how much the refund is as to whether they would bother even trying.

I think if I were you I'd just keep quiet and hopefully the funds will be paid to you. If you are discharged then you are doing nothing wrong.
