Redundancy whilst in a trust deed

Hi, looking for some advice.. I'm about to be made redundant and start on maternity leave. My trust deed is due to finish in March 2010 and if I'm being honest they aren't the most helpful people.. What will happen to my redundancy package?? will they take the full payment off me ??

Hi McGrel

This is a bit of a technical one...

The statutory redundancy payment to which you are entitled by law is yours and cannot be taken by them. However, if some of your package is additional to this statutory level (ie because your are entitled to more due to the terms of your contract) then this element can be requested by the trustee as "acquirenda".

That doesn't mean that they will definitely seek to do this though and you may find that your trustee is happy to let you keep all of your redundancy money given your circumstances. Let's hope so!
