Reduced Monthly Payment

When I started my TD in Oct 2009 I started payments on the same month I signed. Part of my debt was to my employer NHS credit union. It tool them a few months to adjust my salary and stop taking my credit union payment from my salary for the first 3 months of my TD. As this left me short of money my TD company Invocas kindly reduced my first 3 payments and told me they would claim the money back. At every review since it looks like I defaulted part payment for the first 3 months and Invicas have been unsuccessful in claiming the amount from my employers. I foresee future problems at the end of my TD. What can I do here.

Hi Mrs Mac.

It's quite difficult to speculate here before any problem has actually happened.

Has the reason for the problem with reclaiming the credit union payments been explained to you?

It seemed to be ignored and only came to light at the first review when it was noted that I was behind in my payments as if it had been some fault of my own. When I pointed out to Invocas what had happened they said they would deal with it. At my last review I was still behind yet have made every payment on time as asked. When I pointed this out I was advised it had been missed as the person dealing with my account had changed so often and it would now be dealt with. That was in Jan/Feb and I have not heard any more from them since so I await my next review and see if it has been dealt with.

I think it might be a good idea to contact them again to see if they are getting this sorted out Mrs Mac - your experience so far makes me fear that unless you do then not much might have happened by the time you get to next Jan/Feb

I took your advice and contacted Invocas who tell me they have written to the NHS credit union twice and had no reply, they said they included a copy of the regulations that state they are not allowed to have received any payment from me during my trust deed as that would have meant they were getting more than other creditors however they have not received any reply. It had clearly not been noticed that they had not received a reply though till I brought it to their attention. They say they will now look into this for me but this is what I was told at the beginning of the year and the beginning of last year and I foresee little being done here. I guess I have no option but to wait and see but if they do not do anything and do not claim this amount back it could extend my trust deed by 3 - 4 months when it finishes as it looks like I am behind with my payments.

I doubt that will happen Mrs Mac as your trustee seems clear that this money should be repaid.

It wouldn't seem right that you should be penalised because the credit union involved isn't being sufficiently responsive.
