Re ppi and RBS

Hi new here and looking for advice on the following

I recently applied for a refund of PPI from RBS after being in a trust deed which I was discharged from in 2010 I was open with them and sent them my discharge letter with my application. I made a claim against a RBS credit card and two RBS loans. I. Heard back very quickly from the credit card and even though they mentioned about trust deeds I received a cheque for 224.00 so they didn't keep any even though I was in a trust deed with them.. I then received a letter at the end ofFebruary saying I would get a payment of 2227.00 for my PPI in relation to my loans, It did mention the usual about being involved in live trust deeds, today I phoned them as since I have changed my name since trust deed they say they can't match my signature due to my name change so was asked to send a passport to verify the name change, but when I asked when I could expect the cheque I was told I might not get anything due to my trust deed even though I was discharged in 2010...... I don't understand how the same company can give me a refund for my credit card then say that about my loans if this was the case why did they pay me back PPI for the credit cards, but I suppose I will need to wait and see. Any advice would be gratefully appreciated. Thanks

Oh and the funny part is that they said the payment department need to see my change of signature/ name before anything can be processed yet the girl on the phoned said I might get nothing due to the trust deed

Welcome to the forum busybee124.

I think we've heard the same thing from another member in the past, Neelia.

RBS do seem to have taken the view that they don't need to repay PPI where they've written off debt in the past due to a trust deed.

Why this might apply to some types of debts but not others I have no idea.

If they do refuse to pay the PPI for the loan would I have a case with the ombudsman since they gave me back my money for the credit card ppi but I will keep you updated....gonna send of my paper work through re name change and then wait and see if I do get a cheque....do you know if anyone has been successful in getting a payment back from RBS after a trust deed.

The feedback here has been that they don't seem to be paying in these circumstances, though I think Neelia also said that they'd been paid on an account but not others. I think the paid account was a credit card.

You have nothing to lose by going to the FOS, though I don't know whether they'd find in your favour.

Thank you for your advice, but can you tell me from your experience on the forum has anyone ever been successful in getting their ppi back from rbs after trust deed, just find it strange how they are asking for confirmation of my signature and paid me my credit card money not keeping my hopes up but it would be nice to ge a little cash back...plus looked at other info on moneysaving expert and they are quite abusive not helpful like you all are on here, yes we have gotten into debt and yes not proud of it but to get abuse on that site it pretty low so ty for all your help and understanding on here you do a great job guys xxxxxx

It's a shame that people haven't been polite on MSE busybee124.

I do think that some people take the view that it's unfair that debts get written off and then PPI is paid back by the same bank. That view is maybe hardened when it's a state-owned bank and, effectively but indirectly, the other citizens of that state are funding any repayment made to you. Whatever you think though, there doesn't seem any need to be anything other than polite even if you disagree about something.

It seems like RBS do things in a certain order and that insolvency checks come right at the end. That's my guess why people are asked to sign things, with a refund seemingly imminent, prior to it then being rejected on the grounds of the trust deed.

I'm afraid it does seem like RBS have been rejecting most claims of this type from what we've read here. The exceptions seem to be limited, as described in my previous posts, and perhaps related only to certain types of accounts (though I'm not 100% sure if that is the reason for the difference).

Just to update on my ppi with the rbs after trust deed, received my letter today to say that my ppi has been retrieved by the rbs after my trust deed, to my old loan which I have to say was expecting after reading previous posts on here.... I owed them the money in the first place so I can understand why they took it back but why are they the only ones doing this..... but ty guys for all your help your site is very useful as I know I'm not alone xxxxx

Glad we could help Concerned man, even if you didn't get the result that you hoped for.

I guess RBS have just obtained advice that they're within their rights to do this. As they hold the money it's up to someone else to challenge them... something I doubt very much anyone with sufficiently deep pockets for it to be possible will choose to do.

Hi
We have just discovered we had ppi on mortgage for several years (well before entering TD) would it be unlikely that we will be able to claim ppi then ?? Even although it was mortgage as opposed to credit card. We did have rbs debt which was included in the TD. Are rbs allowed to take ppi from mortgage to cover some of the debt from
credit cards ??

Hi boys1211.

I don't think any of us know. It not really a question of "allowed", RBS seem to have decided that they can offset in certain circumstances. As they hold the money you'd need to take steps to force it from them, steps which might be expensive and might not work.

It's not going to cost you anything to find their position out if you believe it was missold and pop in a claim yourself?

I posted on here in 2014 regarding the rbs offsetting my PPI against a trust deed which had ended a year before but now have read that the courts have over ruled this at the beginning of 2017 do I have any chance of re applying to get my PPI back from 2014 any advice appreciated
