If someone can post updates to here that would be great for people who don't do WhatsApp. Thanks
I don't do whatsapp either, just been posting if I get any reply from RBS, just the usual ' we hope to have a decision soon' response to date
Just had a look on forum .my apologies to anyone not in WhatsApp group could I ask anyone not in group if you could email me on lukecg@aol.com and I will bring you up to speed there is currently a complaint in against the FCA. I would like to forward you there reply and you can read .
Hi,
I have joined the Whatsapp group at the beginning of its formation, and it is very active with most people participating. We are on the cusp of getting MPs and the media involved with Colin Luke the main driver. I would ask the Advisors in this forum if they consider the "splinter group", to be detrimental to the drive to achieve a satisfactory outcome for all those involved in the campaign against RBoS in its unfair dealings with our PPI claims?
Hi Duckbill,
As you know, from the perspective of the site we don't take a position on this issue. It's very clear that both sides of this dispute can put forward very strong arguments as to why they should prevail.
We do have great respect however for those of you who have chosen to organise away from this website to fight your corner. That's why we left Colin's personal information available for people to see on the forum when, usually, we'd remove it under our forum user guidelines.
There are still a lot of people reading this forum thread on a daily basis, many more I'd guess than have decided to join the WhatsApp group that you have set up away from this website. I'm sure they'd appreciate hearing of any significant developments if and when they arise if someone wanted to add them here.
The WhatsApp group is now numbering about 30 members. Colin has had a call from FCA who are aware of the RBoS shenanigans and the feeling within the group was that our numbers might be a bit low for the FCA to react quickly. Might I ask if there are any forum members who have not written to FCA, to do so with a complaint and that would boost our numbers considerably? You should email them at consumer.queries@fca.org.uk.
Hi anyone had anything back from rbs? We got letter stating that they are not paying out our ppi monies angry dose not cover my feelings
Got a email from rbs ppi executive today saying a letter has been sent out in regards to ppi. I will post up what the letter says, when or should I say if it turns up.
HJAW
I've not had a reply to my last email. I'm now thinking they didn't bother as this letter is coming which doesn't sound good news going by recent posts. Looks like RBS has won if they are not going to pay, disappointed!
I got the letter today from Rbs which basically says they will keep the ppi if I agree and open a court case to get the trust deed reopen if I do not agree. So they can offset the ppi Redress.
This is my email response to them in full.
In case it helps anyone else.
Sorry its long.
Hjaw.
Hi Mr Hutcheon,
I have today received the letter you referred to below. I would like to formally reject this offer on the following grounds. Which we will use as the basis in any court case.
1. Before we went into our trust deed we applied for ppi Redress with Rbs and where informed by that we did not have any.
2. We only went into a trust deed because royal Bank of Scotland where attempting to convert a unsecured loan into a secured loan and then to enforce with the sale of our house. Every other creditor where part of a payment plan.
3. Wylie and Bisset, our trustee supplied document to the court to this effect.
4 Wylie and Bisset. Used agents to check for PPI and Rbs again said there was none for me. But there was one for my Wife but you could only payout 50% as it was a joint account. Using that information we then tracked down numerous accounts in my name. But as my trust deed had just ended at that stage. Wylie and Bisset had been discharged and the claims returned to me.
5. The 50% claim on my wife's behalf was never sent to Wylie and Bisset. Basically Rbs attempted to retain that also.
All of this information is public record and was posted into numerous trust deed forums looking for advice.
In the court case the letter refers to. I will ask the court to reopen the trust deed. And re install Wylie and Bisset as the trustee. Then to contact all other creditors so they can receive a pro rota amount of the ppi Redress as Royal Bank of Scotland should not be the only to benefit from this.
And after Wylie and Bisset fees have been recovered from this. You might then get something back.
The full point of PPi Redress is to put us the clients back to the same position as if the mis selling had never taken place. THIS CAN NOT BE UNDONE FOR US. as Royal Bank of Scotland was the only reason we went into a trust deed in the first place. If Rbs had acknowledged the ppi in the first place the amounts involved would have or just about cleared our debt to Rbs.
There is no way in this lifetime that Rbs should benefit solely from their mis handling of our claims. YOU CANT HAVE 2 BITES OF THE CHERRY.
This email will also get posted to trust deed forums so it becomes a mater of public record. And Rbs can't say we agree to your offer.
With regards
?????????
Also can WhatsApp group get informed about this latest development. I'm sure some of there members are still here.
Thanks
Very disappointing news, I guess it will only be a matter of time before I get the same letter. That's it for me, I'm not reopening anything from nearly 20 years ago, from since when I have turned everything totally around. Grateful for the PPI I did received totally unexpectedly from other companies, so still a win in my eyes, although the additional from RBS would have been lovely! Thanks to everyone on here who has posted, was great for information during this saga.
Thanks for sharing the new information. It will be interesting to see whether they do carry through with their stated intention to go to court to ask for the Trust Deed to be reopened - I hope you will keep us updated, head-just-above-water.
By the way, how much is the sum we are talking about here? I think that might be an important factor.
The total from rbs ppi Redress was over 15k they have paid out on mortgage protections and credit cards as they are classed different to loans leaving 4 for me and the 1 for my Wife totaling approx 8k. The wife's ppi was discovered by the ppi agent Wylie and Bisset appointed and that then lead to finding about about mine. But Rbs never sent the money to wylie and Bisset so still sits unclaimed.
I will post up when I hear back from them.
