Just an update for your interest as I chase my monies which were offset by RBS.........note below I have had from from Solicitors handling the Donnelly case :
RBS are now issuing proceedings to try to have the final distribution reversed and the Trustee re-elected. This was in line with comments made at the end of Dunoon case.
Also I have have raised this with the FO...there comments last week were :
"There's another case that's currently going through the courts, this case addresses the issues mentioned in the Donnelly v RBS case, so we are awaiting the outcome. We do not have a timeframe as yet on the decision but once known we shall revert to you regarding your claim"
Looks like were are all in for a long wait again........
Sounds like the PPI RBS saga has a bit more to go before it's resolved and closed for good.

Question for the experts -
If RBS are successful in reversing the final distribution, should those of us who have already received PPI be concerned that the same may happen to us?
I don't think so, amorphous. If the funds have already been paid out then I'd be very surprised if any action of this sort would be taken - too high a risk of costing them money in legal fees chasing money they would probably be unable to recover.

I hope its ok to join in here, I also had my ppi off set is there a template letter or wording i could use to fight against this? or is it just a case of waiting for the legal outcome? I see from this forum there have been a couple of payouts

We don't think anything has changed I'm afraid.
I think it might be best to await legal developments if you've already been informed that RBS has set-off your PPI against an old debt.

Rbs sent me a letter somtime ago regards off setting my ppi monies. I have since tried to find out what is happing on the time frame rbs has to go back to court to try and over turn previous verdict.

Gazza, I was advised by RBS that they had hoped this will go back to court for a decision first half of 2019, but like yourself I have heard nothing and keep trying to get an update regarding decision from court will be made.

Hi all, I'm new to the forum and I understand that the Donnelly case has been sisted some time ago. Can anyone tell me the Court which the case will be held in, and is there any easy way to check when the case shall be coming up. eg. is there an advanced role or something which we can look at?
I'd appreciate any Scottish Courts phone numbers which could prove useful. Thanks everyone.
Hi Duckbill, I think they are on the last appeal which means it has to go to the Supreme Court. They do have a list but not sure how far in advance it gives you or if it is ongoing hearings. Iโm sure someone will be able to tell you if I am correct regarding RBS appealing to the Supreme Court.
I took this from the scotcourts rolls on their website, but I don't know if it is significant regarding any movement on the Donnelly case.

I've just copied this from the internet:
"A procedural hearing is a hearing fixed solely to decide on further procedures to be followed. No evidence will be heard and no decision bearing on the merits will be taken on the basis of such a hearing".
So it looks like plans are being put in place for this case to go ahead again.
