I haven't posted lately as I returned to work after maternity leave at the end of January and have been super-busy.

However, I had a case at the Ombudsman against RBS who had failed to claim their dividends from my completed trust deed - both from my trustee and later from AiB.

Instead, they used the majority of a successful PPI claim (which was more than I owed them) to clear the original debt. I never had an issue with them using their right of set off, so I wasn't arguing that. I did, however, have a problem with having done my best to pay into a trust deed in good faith for them to then tell me that they didn't need the dividends so would just leave them with the AiB to eventually go to the treasury.

I got confirmation this week that they have admitted this was wrong, and they have claimed the dividends. They are going to absorb the AiB charges and return the money in full to me, plus interest, plus ยฃ150 compensation (an amount voluntarily offered and more than the Ombudsman adjudicator would have even recommended). It would have cost them less if they have just listened to what I was trying to say in the first place, but there you go.

A good result, all in all.

That seems fair tanyadm.

As you described the situation previously the way RBS handled this didn't feel right.

I'm glad that they've taken steps to acknowledge that.

Hi Tanyadm,

I've followed your posts regarding your ongoing issues with RBS and I'm pleased to read that you have been successful in your hard work and they have now seen sense.

Well done in following it through and for the positive outcome!
