Hi mark thanks for your earlier reply. I just wanted to ask you if there is anything else i can do regarding the car situation or will i now just have to pay what they are asking. As i said earlier i did try and come to a compromise with them but he is refusing to budge but it seems a little unfair when i know the car isn't worth what he is saying. As i said in an earlier post the exhast is now being held up by a shoelace lol and is in really poor condition. In his response letter he advised me he could take the full 1690 off me not just the 600 and if i didnt want to buy it from him he could sell it, i feel a little threatened by this and dont know if i keep moaning about this he will put the price up. What do you think i should do. the car is still under finance in my partners name will this make a difference im not sure if he could sell it if the car finance is in someone elses name. Sorry to pester you again. thank you.

Is the car definately yours. Is the finance HP or was it a loan taken by your partner.

I think the difficulty is what was agreed at the start concerning the car. It may well be that this was built into the proposal. It is the reason why I always say that these things shouyld be fully clarified before signing.

Hi mark sorry i was a bit vague its quite complicated. The car wasn't involved at the beginning of the trust deed as although i used the car it was my now ex partners. When we seperated he signed over the V5 documents to me as i needed it for kids and work and he had his own car anyway and i took over the payments although the finance is still in his name. The car is paid off in july/august and then my ex partner is out of the frame. the trustee was notified about the car roughly 6 months into trust deed as that is when i took over payments, But nothing was ever mentioned about me paying the equity in the car until my final review. And it was then the trouble started with the disagreement about the valuation. I just dont know what to do next. thanks for your help.

Sorry for the delay in getting back to you.

How exactly is the car yours? It's under an HP agreement, financed to another party and ownership of the car dies not pass until the final HP payment is made.

The V5 may be in your name, but the keeper does not mean the owner.

thanks for getting back to me mark the finance will be finished before the end of my trust deed will this make a difference or are you basically saying they cant say the car is an asset of mine because the finance is in someone elses name. i have the fear of these people dont want to push my luck with them. thanks again soz for being a pest.
