hey ive been in ptd for 3 half years now was wondering would i be better giving up my house before end of trust deed as there is no way anyone is going to give me equity i still owe £28000 on my mortgage and £26000 to pay of trust deed the house was last valued about 7 years ago was valued at only £55000 spoke to someone at c a b they said best bet is to post keys of house to trustee but what happens to mortgage who pays that if im not staying here and trustee has house im sick with worry over this wish to god i had realised what i was doing but when your desperate and down you will do anything why are they allowed to make people homeless the only way im going to get house to live in is by private renting it has even put me in arrears with council tax city council sent paid tax to trustee and demand that i pay over again any advice you could give me would be much appreciated

Has your Trustee asked for a specific sum to bring the trust deed to an end?
I assume that the subject of equity in your home was raised when you were first thinking about starting a trust deed?
If the only way to address the significant amount of equity is for the home to be sold I'd suggest that you contact your trust deed company, indicate your willingness to do this, and ask them how you should proceed with that from here. I cannot see why there would be a need for you to be paying a mortgage and rent at the same time.
The situation regarding the Council Tax seems unusual. Just to confirm, are you saying that you paid money to the Council who then sent it to your Trustee and are now asking you to pay it again?
he hasnt said a specific amount but when trust deed started they calculated i had £26000 equity in house and i could get it valued at beginning or end of trust deed i owed £28000 in debt recieved statement from then saying i owe £26000 now even though ive paid them £203 month never missed it and yes they stated they sent 3 cheques to my trustee and i have to pay council tax over again paying that at £100 month plus trying to pay this years as well i did ask about this never had reply

I'm afraid I don't understand the Council Tax situation. Hopefully one of our trust deed company representatives will have a feel for what may have happened with that.
It is good to hear that the equity responsibility was explained at the start of the trust deed though I appreciate that this helps little now.
I think perhaps you should write to your Trustee personally on both of these matters to clarify where you stand and to start the process of agreeing a way forwards.

Amy council tax arrears from before the trust deed was signed do not need to be paid. Any arrears from after signing do.
Did you pay to the sheriff officers rather than the council? They wou;d only deal with arrears so maybe that was why it wasn't put towards your ongoing charge and they just sent it on to your trustee instead. You would need to ask your trustee to pay that money back to the council as it shouldn't have gone to them in the first place.
thanks money was paid to sheriff officers then i got it clear was paying and up to date when i got letter to say i was in arrears when i finally got through to council was told they sent 3 cheques to trustee and i was to pay these years again tried to argue that you donnt pay anything twice was told my wages would be arrested asked trustees assistant about this she said she didnt understand and would get back to me im still waiting so sent letter few months ago still no reply they put me on a extended year with trust deed when i asked what would happen if housing market wasnt any better was rudely told were not debt managment so really not much hope now as market still much same if not worse

Can I ask if the td company has gave you any offer to even try and pay the equity up? I realise its a substantial amount, but hopefully you wont need to sell. I need to find £22000, but £15000 of it is just for the house, am struggling also to get this together.
no they have never mentioned paying it up but at end of the day whos going to pay off mortgage and pay for the dealings of the house there is a lot needing done to house so they would need to sell it for lot less if that offer did become available yes i would pay it up rather than move im just so sick of worrying bout it im not even caring now
