Hi, I signed my trust deed agreement in August and it was posted in the Edinburgh Gazette on the 9th Sept, my 5 weeks are up tomorrow. How will I know if my trust deed has become protected or not? I am receiving approx 20 call a day plus texts and e-mails from my creditors asking for payment and despite being told of my trust deed they keep contacting me and I don't know what else to do.

Welcome to the trust deed forum AlphaB.

Most people either receive a phone call from their trust deed firm, or call the firm themselves to confirm whether it has become protected.

I'd suggest that during this conversation you ask for some help from the firm in communicating further with the creditors that are contacting you. It would appear that they are not communicating effectively internally as their organisations certainly will have been made aware that you signed a trust deed.

IIRC i got a letter saying mine was protected - i'm sure you will be fine.

As for the phone calls etc, let the callers know you are no longer dealing with creditors and tell them the details if your TD provider, and if they persist let them know that you will report them for harassment under the telecoms act.

I think it is quite common for some creditors to wait until the trust deed becomes protected before they stop any further calls/letters. Hopefully it will all stop soon AlphaB

Hi, thanks for your comments it does make me feel that I'm not the only person thats gone through this process. I called my IP today to check on the status of my trust deed, I was told that my creditors have until 5:30pm tonight to object but as yet nothing, so fingers crossed... I'll let you know next week.

I got home yesterday to a letter from LloydsTSB demanding payment by the end of October or court action will be commenced. It was quite a nasty letter so I've passed it to my IP and will see what happens next.

I'm sure everything will be fine - hopefully they will tell you before they pack up for the weekend rather than leave you sweating?

I hope you find out soon.

Of course if the trust deed is protected Lloyds TSB cannot take any legal action against you, even if they wanted to.

It will be interesting to know whether they have supported the trust deed, or objected to it, while sending this serious legal threat to you.

Sounds like a computer generated letter to be honest. The correct thing is to send it to your trustee like you say.

I'm willing to bet by 5.30pm your TD will be protected.

I'M PROTECTED!!! Just off the phone with my case manager and she has confirmed that they didn't receive any objections to my application and she is going to send of my registration today. It already feels like a huge weight has been lifted of my shoulders and I can actually start looking ahead and see a light at the end of the tunnel. One payment made only another 35 to go... Thanks for keeping me sane
