Hi all

Does a Trust Deed also include property abroad. I don't actually have property abroad (I wish) but it is something I've wondered about.

Hello catoneil,

A Trust Deed would include assets wherever they are in the world.

I'm sure our experts will have worked with people who have owned properties overseas in the past. It might be useful for other readers if they could explain how this may be managed in reality.

Yes, it includes assets worldwide. In the old sequestration days it was called tantum et tale, which means everything.

However rights and claiming ownership to assets abroad is at the discretion of the law of that country. As an example, we had a case in Southern Ireland and it was at the discretion of Dublin Court to register title to the property (which they did)
