Hi There

Would the monthly payments change if someone on a trust deed got pregnant ? When they were on maternity leave and if they went back to work and done less hours ?

Hi lynzmac24 and welcome to the Trust Deed forum.

The answer to your question is that there are mechanisms by which the monthly payment into a Trust Deed can be changed if circumstances change. This does depend on the Trust Deed remaining "viable" however.

In terms of what this means for you it really depends on where you are in the process.

If you are considering a Trust Deed and you/your partner are already pregnant this should be brought to the attention of the Trust Deed firm before you sign the Trust Deed and arrangements put in place in advance to cover this.

If you are already in a Trust Deed and you/your partner have just found out that one of you is pregnant then you should contact your Trustee to start planning around this.

What TDA says is correct lynzmac24. All I would add is that usually it is possible to work around a pregnancy by reducing/suspending your contributions, though you may be asked to lengthen the term of your trust deed a little to compensate - so that the effect on the dividend paid to creditors at the end is minimised. However, there is no hard and fast rule and different IPs will deal with this kind of thing slightly differently.
