I have been contacted by 2 of my creditors which i finished an iva with 3yrs ago relating to ppi claims.
In the process i was told i was due a figure of ยฃ446.00 back but due to there system still showing as outstanding they have cancelled the claim.
I understand the accounts went into a trust deed by am i incorrect in saying that i should at least get back the ppi payments before the accounts were taken on with the iva? and that there systems should have been updated 3 yrs ago to state they were settled and not outstanding?.

Hi couped.

Could you confirm whether you were in an IVA (England/Wales/Northern Ireland) or a Scottish trust deed?

You're unlikely to receive a PPI payout from any firm that had to write off money on the same accounts as part of an IVA or trust deed. I'm not sure that I disagree with that position, and I think it's one most of us would adopt if we were sat in their seat.

Your credit file should reflect that you no longer owe these companies money. I think it's probably a matter for your creditors if they keep a non-public record that your balances weren't in fact fully repaid. These are two different things really.

I think I agree TDA on the whole- but in those cases where higher payments included the PPI premium, I don't see the lender as innocent in creating the situation where payments cannot be met and particularly where people lose an income only to find the PPI does not apply and in fact, never was applicable. hmmm

Companies will offset written off debt against any ppi claims. This poses bigger problems if you hire one of the millions of ppi reclaim firms to do the job for you,as you will end up with their bill to pay after creditors dont pay out due to off-setting!!!
