Hi TDE,Mark, David and Kevin a Happy New Year to you all.It was just to keep yous up to date as promised regarding my ex TD Company trying to reopen my Trust Deed.
I spoke to the lady dealing with my case on the 24th Dec 2014 and was advised their Top Lawyer had still no further information for her and she would contact me when she had anything to tell me.Is this a costly thing for them to challenge after all it is a Scottish Law once you've been discharged and your Trustee has also been discharged then that's it complete or am i wrong in thinking this ?.They are calling what they are doing as a " Test Case" with myself and others who they had in Trust Deeds and now been discharged as i previously mentioned in an older post. I'm beginning to think they must have a case as surely this would have been thrown out of court rather quickly if they didn't have a chance of reopening these Trust Deeds.

Hello Hoopy.

I'm sure they'll have arguments that they believe (or hope) that they can rely on, but this would still be quite a change so whether they'll win or not must be a matter of very significant uncertainty.

I guess that pretty much everyone in court believes that they have a case of some sort, but whether it's enough to prevail is a different matter. One side wins and one side loses!

That, of course, is if it gets to court at all.

I think these things are always costly.

Thanks for your reply but there was no need to at this hour when you've had a busy day but much appreciated as usual.I do also accept that it may not even get to court but has been dragging on a bit.Lets say it did get to court and this side wins would this not have a big impact with people who where in Trust Deeds and discharged only now to get a letter through the door saying the company they were with are now reopening their case for some reason or another.
Anyway take the rest of the night off now you've been far to busy unlike the guys he he .

Hi Hoopy.

There is a precedent with other types of insolvency in Scotland and elsewhere in the UK.

If this did change it would be irrelevant to almost everyone, it's only something that I think would happen where there was a clear problem that resulted in an unfair loss for the creditors.

With that in mind, you could argue that nobody would lose out at all. Even if your trust deed were re-opened it would only be to take care of an asset that rightly should have been taken care of during the arrangement itself.

Of course I understand for many reasons that nobody would welcome this happening to them.

Hi TDA,Mark and David my sincere apologies for not getting back to yourselves alot sooner but i was in hospital for almost 16 weeks after my 2nd Transplant but doing well now. It was just to let yous know as promised that i received my share of the PPI money towards the end of February after my ex Trust Deed company decided to take the case no further .TDA did say that everything would work out in the end and she was correct.
My ex TD Company never did give me a reason for backing down but maybe it was to costly for them.
I feel for Pascal12 as i thot i was getting a hard time from my Ex TD Company but it is nothing compared to what he/she is going through.
Good Luck Pascal12 you've came this far don't give up.

Glad it all worked out in the end and hopefully your now on the mend. Sounds like a helluva few months.

Interesting why they backed down in the end, but glad it worked out and at least you got something back.

16 weeks in hospital is a long time. Glad to hear that you are doing well and that things have worked out for you regarding the PPI.

Best wishes for the future and enjoy the money. Maybe a holiday somewhere nice and warm to help with your recovery.
