Hi All I'm new to this site but been reading it for months. First of all I think David, Mark and all the trust deed experts do a fantastic job giving out great opinions and pointing people in the right direction with their problems even at unsociable so keep up the good work as people are looking for professional honest guys like yourselves.
I was in a Scottish Protected Trust Deed from June 2008 and successfully completed my obligations and was discharged in June 2012.My Trustee was discharged in July 2012.
In 2006 me and my wife took out a large secured loan with Paragon and to pay off credit card debts and to get a bigger car as we had twins on the way. With the expense of clothing, food ,bills the Paragon loan and also a RBS loan i was back to using credit cards and store cards til it all came to much and took advice and went down the Trust Deed route minus the Paragon loan as that was a secured loan .
To cut a long story short i took ill and lost my job due to a serious illness and the money i got i paid off the Paragon loan in 2014 . We've now had an offer of £9000 due to us in ppi money .
1) do you think we have a chance of getting it ?
2) if i didn't get it would my wife get her half as she has never had any credit cards or been in debt apart from the Paragon loan?

From what you say, no money will go to the Trustee as they have been discharged.
There are 2 scenarios which are likely. Firstly they will offset the loan against the existing debt which I think is probably the most likely scenario. Secondly you and your wife will receive the cheque.
The only reason why I say the 1st is likely is because I dealt with one fairly recently where that happened. That said, there may have been different circumstances etc.
Have they given any indication whatsoever if this will be repaid to you or against the loan.

I've just done a little editing to bring this all together on a single thread. I hope you don't mind... I think it will make it less confusing for readers and those who are responding.
Worth adding A.D's response here to you on the first part of your question (which I'm deleting and have added to your question above).

Hi Mark and David thank you for your replies to my query.Mark the whole loan we had with Paragon has been paid in full with the money i received from early retirement so i owe them nothing. David the company dealing with the PPI claim are called CT CAPITAL PLC it was actually them that sent the PPI details to us it wasn't even ourselves that made the claim.
They said the money would be paid into my bank account in 28 days, 24 days have now past and nothing as yet. I contacted them last Thursday to see what the latest situation was and they advised me that they were waiting on a reply to an email they had sent to see if any of us were in live bankruptcy or Trust Deed situations and would chase it up. I have a noddle account that says I'm not in any of these situations and my wife clearly is not. Regarding RBS this year they offered me £8000 but like other people on this site they offset against the loan that was included in the Trust Deed but they did send me a cheque for over £2000 for the interest . I didn't see the point in taking it to the FOS as they have done this to other people who were in a Trust Deed and seemed to get away with not paying the PPI money.During my Trust Deed from June 2008 to June 2012 i never ever spoke to my Trustee as it all ran smoothly and as stated he discharged himself in July 2012 and PPI was never even mentioned .I myself only started to hear about PPI when the guys in work started talking about it but i took a back seat because of my situation.

Hi Hoopy,
My concern was the PPI refund was coming from a creditor like RBS who may offset the refund against any debt that you had with them.
Is it Paragon that the PPI refund is coming from? If so and you have repaid them their full balance then I think you may receive the PPI refund.
I would chase up your PPI claim company for an update and you can refer them to the Register of Insolvencies for confirmation that you are not still subject to a Trust Deed.
Fingers crossed that you receive the funds.

If both you and the Trustee have been discharged, then hopefully the payment will be made to you. You could check and print off the details from the ROI and send this to them as this will answer their queries on the bankruptcy issue.

A.D Thanks for your reply but when i took out my T.D in 2008 i didn't even know about this site in fact i didn't even have a computer or the gadgets that my kids have now lol.
Thanks David and Mark again for your. replies i have registered with the ROI and struggling to find my details to print off but will keep working on it. I did phone ROI and they confirmed that i was discharged in June 2008 and my Trustee was discharged in July 2008.
I will phone CT Capital and see what the situation is and let yous know what they say.

Hi Hoopy,
Your details will only remain on the register 1 year following the date of your trustees discharge.
If your Trustee was discharged in 2008 then then your details will have dropped off the ROI by now. This in itself should be confirmation enough that you are not still subject to a Trust Deed.
Get onto your PPI company to try and push things along.

I understand what yous are both saying but the person I spoke to could still bring up my exact details.Are you both saying then that my details will not be on the ROI website?

Hi Hoopy.
I'm sure internal records are kept to answer questions such as your own, but on the publicly searchable version of the register the entries are removed a year after the trustee is discharged.

That makes sense and that's probably why i can't find my details on the ROI website.Thanks for your reply your as sharp as a tack .I'm going to phone CT Capital just now to see what the situation is.I was thinking no news is good news and was going to give them there 28 days as I'm one of them sort of guys who doesn't like hassling folk.
