PPI payment and Trust Deed

I am at court tomorrow as my trustee has decided to try and re open it to claim back money I have been awarded. Any advice on what to say ?

I don't think anyone can give you advice on exactly what to say. I can only tell you the things that would be running through my mind in your position.

If I had a lawyer or someone to give me support in court, I'd make sure that they know about the recent judgment mentioned in TDA's first post on the thread called 'PPI after discharge HOT OFF THE PRESS'. I'd make sure they mention it to the court.

If I didn't have any support in court I'd let the sheriff know that, and ask if I can have some time to find someone to support me who has been dealing with this kind of case.

I'd make sure to mention the judgment in the other thread and point out that it looks like the case was very like the situation I'm in. And mention that that's another reason for needing time to try to find someone experienced to support me in dealing with this.

I've no idea if any of that would work. But it's all I've got so I'd give it a go.

Good luck Glieth, and well done to you for taking this on in court, i suspect you wont be alone in fighting this ppi issue in the future as hopefully people start to realise these companies can be taken on, and the courts will start to get familiar with this proccess and the recent court ruling, as Candlewick says, no one can tell you what to say in court but if i were you i would keep focused on why i am at court in the first place, and prepare all paperwork and evidence accordingly, i would note down and recite my defence and make sure you get my point accross if asked, i would stay positive and state facts about my situation and how they have or may affect me in the future, i would prepare all financial evidence inclusive of bank statements and original trust deed agreements to back up my case and ask the court to understand that i am fighting this without representation and hence require a bit of time to answer and deliberate my case.
All the best to you today and stay positive as im personally optimistic that this and other cases will prove pivotal to these ppi claims.

Well I attended court and to say I was nervous was an understatement. The sheriff said he was very sympathetic towards my case. He asked me to put it writing my side of things carefully going through everything. I have till the 6th April to do this. There will be a hearing on 20th April. I have contacted CAB and they will try and help. I have a good feeling about this and hopefully won't even come to a hearing as trustee will just send it to me a it is rightfully mine.

Thanks for letting us know, Gleith. I have heard in the past that sheriffs are helpful to people who don't have a lawyer to act for them. Nice to hear that this was the case for you, and that the sheriff was sympathetic to your position.

I hope that CAB is able to help you put all your answers in writing - and that it helps you successfully defend your position.

Would depend on the CAB. There are free legal centres in some areas that bureaux refer to, but is a bit of a postcode lottery I think...
