just wanted to share a Story ith you about offsetting. a few weeks ago my sister got a letter from the RBs advising her to claim back her ppi, I helped her fill in the form and got a letter back saying she was due £3k, I didn't see the letter before she quickly signed it and sent it back. Once she showed me the letter it said on the back that any monies owed would be paid into the group. Now I was astonished that all it took was one simplified application form, no paperwork going back and forth for more info, they simply said sign and we'll get the cheque out. What the letter should have said was sign this and we'll take your money off you to pay off some of your debt. Now she is not disputing that she owes rbs, but if given the choice would she agree to offset her ppi for the benefit of rbs , in a word no. They have not even given her the courtesy of a letter confirming this, but if have read in many other forums that this is the case , this is what rbs do. She did speak to the ombusman and they advised she could argue she had more pressing debts to pay, I really don't think that they should be allowed to decide where people ppi money should go.

However, I received a letter this week to advise in advance that this is what they will do. I have been very upfront with them about my trust deed and sent my letter of discharge to them on Tuesday.
The letter I received outlines the various actions they take with your redress depending on whether you are discharged or not.
To be honest, I think it's fair enough. The letter says "at the time we owed you money, you also owed us money". In reality, if I get any offer - which I think would also be in the region of £3k, as I had a £7500 loan with them which I still had £1844 to pay (this included PPI monthly instalments) - then it's unexpected money, and I didn't pay them all that I owed them. If I were still in the trust deed, it would have paid them off, and that would have suited me.
Obviously it's disappointing if you are hoping to get a financial boost in these difficult times, but I can't see how they're not within their right to do so.
The dealings I've had with RBS over PPI have been efficient, polite and courteous. I had bad experiences banking with them, but on this, they've been pretty good.
Having said that, perhaps your sister should try the ombudsman's advice and see what they say? Good luck

I totally share your thoughts on this.
There are Trust Deed cases where ther are perhaps 4 successful claims of PPI. 3 of the companies will pay out and the money goes for the benefit of all creditors. However RBS offset their payment against the debt. As a result, when the dividend is paid, RBS benefit from the other 3 PPI payments.
I also object to the fact that they offset when the PPI was 'missold'. In effect, they are agreeing it was mis sold, should never have been taken, agreed a payment for the mis sold amount and then kept it!

I want to add, that in my sisters experience, they never queried the ppi , there was no request for further information, they did not ask for evidence of ppi or account numbers, they made it easy to get their money. I also want to say that many times people end up in financial difficulty because of bank and credit card companies. They lure us in with interest free offers when we don't owe anything, but by god if you find yourself in difficulties just as I had, they will not lower the interest rates, this is how I ended up in finically straits. I was paying them a monthly payment never missed one, but I was financially struggling and my severely disabled daughter was seriously ill and I did not know how long I could keep working, I asked mbna to reduce / freeze the interest so I could pay off quicker, they refused, so with no where else to turn, I went down the trust deed route. Credit card companies are ruthless and really don't care about you personal situation. My precious daughter died august 2012 and I will never forget mbna for being so unhelpful. Yes I got into the debt and yes I owed them, I don't dispute that, and I know they are in business to make money, but banks and cc companies are not innocent either luring us in with their interest free offers.
I think RBS is misleading people they send these letters out saying sign this and we'll get the cheque out to you, what they don't say is sign this and we'll get your cheque, you find that in the small print, at the back of the letter. Totally dangling a carrot and snatching it away, I think I will draft a letter to them appealing for her and might just send it to the ombudsman.

I have been proved wrong today ...... Not very often that will happen...... Lol My sis got 8 letters today... She opened them 1 after 1 all cheques totalling £3k so glad she is not going to struggle this Xmas , she's a working mum, single parent with 2 kids and deserves to be cut a bit of slack. yippee !

So it didn't get paid into her trust deed or set off by RBS?!
Is her trust deed still active? I thought 'windfalls', which I'm led to believe this would count as, had to be declared to the trustee?
If not, yay for your sister and her kids! I await my RBS letter with even more baited breath....

That's great for her - a shame that RBS can't at least be consistent with their setting off...
Mark you are correct my sis was'nt in a trust deed, but she was in arrears from about 10 years ago, I don't know the ins and outs of the time limits for recouping the monies back, but it seems in her case they haven't. My sis got into financial difficulty, was never made bankrupt or went into a trust deed, they have never taken her to court, basically, it would cost money for them go do and if taking her to court has the same outcome , it would not benefit them to do that. Don't get me wrong ultimately, she will prob never get credit / mortgage again, but like me she has learned her lesson, if you don't have the money to spend don't.
It's banked Mark , it was £200 short from what was in the letter, and I've told not to look a gift horse in the mouth, don't even dare query the shortfall .
Now I know it's an ill divided world but now about my PPI, you know the one I have repaid the debt back in full, I still await the confirmation letter from kpmg to advise they have no interest in my future assets so I can send to mbna
