I made my 39th and final payment to my trust deed in September 2014. At the start of November I called to enquire about my form 5. I was sent a letter saying that I was discharged but my trustee was not as the were pursuing mis-sold PPI despite me previously stating that I had NOT been mis-sold PPI. they then said that if I did not sign another letter of autrhorisation I would not be released from the trust deed. Can they do this despite me telling them repeatedly that I have not been mis-sold PPI? Also they have been chasing this for almost 2 years...

Welcome to the forum CannondaleSL.

Your trustee has no option but to investigate whether PPI you might have been sold in the past was missold and, therefore, might result in more money being raised for your creditors.

You're not the first person to raise this concern here though, that you don't believe that it was missold.

A complicating factor is that there are many grounds upon which a misselling claim can be based, some of which aren't obvious to non claims people like you and I. To put it another way, it's perfectly possible that you or I purchased PPI in the past and have no objections to the way that it was all dealt with, but on a technical level misselling did take place.

Please remember also that any firm accused of having missold to you will be able to defend themselves. If they can prove that they did nothing wrong they'll not be forced to pay anything out.

If they are saying that you have been discharged then you should have received your form 5 already, CannondaleSL. It is quite normal for you to be discharged and released from your obligations to the Trust Deed but your Trustee to remain in office a bit longer to check into the PPI situation.

It might be worth checking the Register of Insolvencies to find out whether you are actually discharged or not yet.
