Looking for help please. I have been in a trust deed for just over 1 year now. I have received a letter claiming PPI which I'm guessing was from my trust deed company. One letter was for £98 and when I phoned BOS they told me the cheque has been sent to the trust deed company. I have received another letter from the BOS saying another PPI claim for £10,000 which a lot of money. I have phoned BOS and this amount has been confirmed. I have not been told anything from my trust deed company and had to phone them and they confirm they had the £98.
This is old PPI from loans from 10 years ago which I claimed PPI from BOS and was awarded but now they have said the amount was re calculated. I'm upset from as if everything was awarded then I may not be in this situation now.
Even with this being old loans and nothing to do with my defaults will this go towards my trust deed or will I be able to keep any of the money during a difficult times as we are struggling.
I'm disappointed with my trust deed company not notifying me of any PPI claim I was owed. If the trust deed company pay it towards the creditors will this bring my payment down or does it just go straight to creditors. My issue is that creditors may only 1/4 of the payment which the trust deed company take most and coffee breaks are like £500 etc.
If the cheque came to me rather than the trust deed company am I able to use this. Please any help would be great.

I'm afraid tinsoldier is correct.
When you signed your trust deed you made your assets available to your trustee to help repay your debts. The potential to claim PPI was an asset, irrespective of whether the PPI relates to a debt included in it.
You need to make your trustee aware of the money comes directly to you - but I doubt that it will.
Your payment isn't likely to change - your surplus income is a separate issue to your assets.

I'm guessing it dosen't matter that these claims have nothing to do any trust deed default accounts ?
My main issue is with BOS. I claimed this PPI in 2012 and received a good payment then one year later I re claimed with BOS due to lots of companies not paying the correct amount. They sent a letter back saying it was correct. Now with this claim coming in saying yes we have looked at it and now recalculated and owe you £10,000. If BOS got this correct first time there is a good chance I wouldn't be in this position.
Could I take this further with BOS for making this error ?
do you know if I would be able to keep a percent of this payment. Does this ever happen ?

I'm afraid what this PPI relates to isn't relevant - just that it's an asset that can help to repay your debts garymc.
You could take this further with Barclays, but any additional compensation would also likely have to be paid over.
I think the full sun will go into your trust deed.
Regarding the final part of your post, you voluntarily signed a legal agreement that obligates you to inform your trustee of any such payment. You're highly unlikely to receive the cheque, but if you did and chose to act dishonestly a range of serious sanctions could apply.

Thanks for the response. It's just frustrating with the Bank of Scotland with this PPI. Like I said there would be a good chance I wouldn't be in this situation if they calculated the correct amount first time or even second time.
If the full £10,000 went to creditors I would be fine with that but I know the trust deed company are more than likely take most of this to pay for photocopies, tee and coffee breaks. They have been frustrating to deal with, took 8 months to get me protected and had to file another trust deed at the end up so I have 2 trust deeds showing on my credit file. Even my trustee was discharged and with I contacted them they said that doesn't matter. While going through the those stressful 8 months and many emails and phone calls to have very little replay.
Just frustrated with this. I wouldn't have needed a TD if I had that £10,000 that would have went straight to my creditors and majority of debt would have been paid off.
I sympathise with your frustration that the trust deed would have been unnecessary had these funds been paid out sooner, garymc.
Whilst it is understandable that you will feel cynical about the whole thing, if it is any consolation I am sure that most of these funds will in fact go to creditors.

I also have had issues. On my credit file I have 2 trust deeds showing up on my credit file, the first was Feb 2015 and another Aug 2015. I have never missed a payment and have spoke to the company as it took 8 months to get protected. They apologise after 4 months and I kept phoning and then they said paperwork was missing and they needed to re do the trust deed, now it's protected but during this my trustee was discharged and every time I phoned chasing this up I was told it doesn't matter about a trustee ? I have now been given a new trustee but on the review it say the trust deed will finish Aug 2015. I was told I would have 48 payments and that started Feb 2015 and will finish Feb 2019 but the trust deed will still be going on to Aug 2019. For 6 months after Feb I won't have to make a payment but will still have a trust deed.
Is this normal these things can happen ? Just feels strange. I can never get hold of the supervisor who was dealing with the case. Every time I phone I get an advisor and they can only tell me what they know but getting confirmation is a nightmare.
