Hi all, I am still in process of claiming back PPI. Had a couple of knock backs and sent back further info so as yet no claim forwarded to FOS. Had one hell of an ordeal getting the banks to comply with my SAR! They try to dodge at every opportunity. Had such a nightmare since May trying to get my SAR from Santander that after much going back and forth (where they lied on a few things and lost cheques) that I ended up email CEO with copies of all my letters and their replies, got a response via email in 2 hours to apologise and to say they are investigating, then a phone call to say they have marked my SAR request urgent sent to the correct team and should have in days. They cashed one of my 'lost' cheques after I emailed CEO, so I am getting a cheque in post for £110 as compensation and refund of SAR money. Hopefully they deal with PPI complaints better than they do SARS. All in all the loady who rung me to say she was dealing with my complaint and any probs with my SAR contact her direct, was very nice and helpful.

Good for you blacklily - from the sounds of it the banks involved should just save themselves a lot of time and trouble and pay out now, as I can't see you giving up without a fight!

Just been reading through this thread for some advice.
I received my discharge letter from Grant Thornton in July this year, confirming I had met my obligations of my trust deed and was therefore discharged.
After this, I decided to check on PPI, and got in touch with Welcome Finance, after a long drawn out process, I would pleasantly surprised to find out I had been sold it wrongly and proceeded to make a claim.
Today I called them back for an update, and was told that the £2500 from the claim was being sent to Grant Thornton.
I phoned them, and they confirmed that although I am discharged, they class this money as an asset and is therefore part of my trust deed, yet the claim is for a loan in 2004 which was paid of before my trust deed started.
Can they really do this after all my hard work ???

Welcome to the forum ukbigman.
At the moment some trust deed firms are "staying in office" specifically to try to raise more funds for creditors via PPI claims. This means that you're discharged from the trust deed and they are not.
If this is what's happening then they will look to take this cash so that your creditors can be more fully repaid.
In this scenario the fact that the account concerned pre-dates your trust deed isn't relevant I'm afraid.
You may wish to confirm with Grant Thornton whether they have stayed in office.

They have confirmed they have "stayed in office", does this mean if there is more money to come in, they get more commission ??
The part that annoys me the most is this is missing money from the family budget in 2004-2006 which has nothing to do with me going in to debt. I only started to 'sink' slowly in 2008!
I was never explained this or recall signing anything regarding this, so was i mis-sold a trust deed ? , now there's a starter for a new thread !!

PPI has been an emergent issue that a few years ago trust deed firms wouldn't have known to discuss with people.
When you appointed your trustee you made them responsible for recovering what they reasonably could for your creditors. This will be the prime motivation, and their regulators are telling them to look into PPI.
The fees are agreed with the creditors at the start of the process, though if extra work is being conducted in relation to these claims it's possible your provider will seek to bill some extra hours.
The fact that the account isn't related to your debts isn't relevant I'm afraid. Your trustee will be recovering what they can irrespective of the dates.
I have finished my TD and been discharged and so has my practisioner. It was when guys at work started talking about PPI that i looked into it. As i had a TD when all the adverts etc were on TV i never thought i would qualify. As everyone at work was getting money i thought i would give it a go. Several weeks later i recieved from the one account several offers from the bank saying they accepted i had claims and made several offers to me totaling £22000. They asked me to sign and date the offer acceptance forms. Does this mean i will get that amount now i am discharged or will they try to with hold the money?
Hi Amy, thanks for the welcome:) What do you mean by reststance? How do i fight the resistance? Would it be through FOS. I never thought i would get anything, so it has come as a shock. The bank admitting i am due compensation to me is admitting they were in the wrong? They got me to sign 7 different claims for different amounts.Are they in the habit of making offers then going back on them and withholding payments?

If you were in a protected trust deed and completed it in 09 then you have no worries, they have to return the money to you, the trustee does not have to give you permission and if the companies give you any stories that they have to put it back on the account, that is a load of ballony, threaten them with the Financial O you should get it turned around within 12 weeks
