ppi claim

hi we have just made our last payment to our trust deed in june.we have been told verbally that our trust deed is finished ,but have still not received it in writing.at the begining of august we were contacted by a co advising us that we could claim ppi on a loan that was repaid years before we entered our trust deed,and it only arose because the loan co had went bust.we pursued this matter and was shocked yesterday to receive an offer from the co for a substantial amount of money.the down side was that they had imformed our trustee.can the trustee claim this money or are we entitled to it????
any advice would be much appreciated

Hi mitch70 and welcome.

The question really is whether you have been formally discharged.

If so, the money should be yours.

If not, it's likely to be required to go to your trust deed so that more of what is owed to your creditors is repaid.

Your trustee should be able to confirm the position for you easily enough.

Hi TDA

Sorry, but the key point is the Trustee being discharged. If he is not, then the funds will go to the Trustee.

The majority of Trustees will discharge the individual, but remain as trustee to wind up the case.

thanks for your speedy reply,we have only been told verbally about 9 weeks ago.should we have had it comfirmed in writing by now.they have told us they are still waiting on ppi claims which we authorised them to claim,should this really be taking this long or are they just dragging there feet.

If they've specifically stayed in office to deal with PPI claims I'm afraid they'll want this money paying over.
