PPI claim

We were discharged in full from our TD in 2010.
We claimed PPI from RBS and were awarded £3589.88. We accepted this claim, and today received a cheque for £1700.99 for part refund and interest.
They say we have arrears and have taken £1888.89. They say they have restructured the written off balance to ensure it no longer includes and element of PPI.
It says the refund will remain with their debt management department until their allocation of funds against our arrears which can take 28 days. Once processed, if there is any balance due to us it will be issued by cheque.
I'm totally confused. If our TD was discharged fully in 2010 surely we don't owe any money now. The amount we did owe was well over £10k, so how can they take this money?
They did end up getting £10k towards the debt, as my idiot of a husband had opened an account in his name, with money his parents wanted 'hidden' , without my knowledge.
They also were included in the TD, so got payment and then it was discharged.
Is this worth pursuing with the ombudsman, or should I bank the £1700 and shut up,

RBS seem to do this as a matter of course, though as far as I know they are the only bank to have decided they are entitled to do so.

I'm not sure that the ombudsman will be of much use to you - RBS have technically agreed to refund the PPI, but have just offset some of it against the old debt. Maybe the ombudsman might take a view on this aspect of it but I doubt it.

Welcome to the forum Feemac.

RBS seem to have taken the view that they can set-off PPI claims against old debts in trust deeds.

This is, as far as we're aware, legally untested.
