PPI being claimed 6 months after being discharged

Hi i entered into a trust deed in 2008 and was ment had been have been discharged in 2011. my insolvancy practitioner said i was discharged from payment in may of that year but i never recieved any paperwork stating how much was divided between my creditors.Now 6 months later at the end of November i recieved a letter from the Halifax saying that a claim for ppi had been made in my name by my trustee.I phoned the halifax and told them that i was discharged from payment of my trust deed may the halifax told me i needed to contact my trustee and ask for a certificate of discharge so the ppi could be paid to myself, when i contacted him i was told that there was no such thing as a certificate of dischargeand that i wouldnt be finished with my trust deed until i had my final meeting with him and that i wouldnt get my final meeting until the ppi was reclaimed. Now my question is should 6 months after being told that i was discharged from payment would my creditors be allowed to claim ppi as part of my trust deed payment and should my discharge be held up while ppi is reclaimed as it has caused me problems in getting a private let house because it is incomplete.

hi amano1666,

this would appear to be a common thing with trust deeds. i myself am waiting on discharge due to PPI claims. My last payment was Jan. So, even though you dont need to make anymore payments, your still not released for a good few months it seems.

I wonder if being discharged from payment is just that. That you have no more payments to make, but you have not been formally discharged.

If you signed post April 2008, then you should have received a letter and form 5 confirming your discharge. If not, I suspect this has not taken place. That said there is nothing to stop them discharging you and them staying in office to finalise the ppi thing.

hi i was told that i would be discharged in february 2010
and my final payment would be in may the final payment was taken and after that i received no further communication until i contacted my trustee in december to find out why i hadnt recieved a letter or certificate of discharge when i got my letter about ppi being claimed and as i already mentioned was told no such certificate existed. when i signed my agreement i was told that after 36 months i would be discharged and that would be done.then six months later i find out that ppi was being claimed on my behalf but received no communication from my trustee that it was being done or having no communication at all either in writing or over the phone after last payment was made. should i not have been informed than i had not been formally discharged from my trust deed or that after 6 months i would then be liable to pay more towards my trust deed in the form of ppi ?

Yes, I agree some communication with you about the situation with PPI and discharge from the trust deed doesn't seem too much to expect.
