PPI and discharge from Trust Deed

My partner completed his trust deed in oct 2009 after signing it in sep 2006.

That will be 6 years next month since the trust deed was signed and therefore, some of his debt history is about to fall of credit files. However, there are some creditors who refuse to update his credit file until the see the discharge notice. I understand that but the Trust Deed company won't issue the discharge until they have claimed any PPI, I also understand that but how long after finishing his trust deed should he have to wait? Isn't 3 years pushing it a bit? How long is reasonable until he can start calling them to chase up the discharge?

Its now stopping us from getting a mortgage, getting finance for a car and living together with our baby that's due in Dec.

Welcome to the forum leilai22.

If everything was completed three years ago most people would justifiably gone nuts about the failure to discharge them.

However, given the trustee is now looking to mount PPI claims, and the trust deed was signed in 2006, it looks like discharge will now be impossible until the PPI situation is resolved I'm afraid.

How long is the average to take to explore PPI's? They have been at it for almost a year already and OH only had 1 credit card from Halifax and 5 store cards

A year seems a very long time. Most claims are being dealt with pretty quickly at the moment.

I'd be asking for a full status update and an expectation of when everything will be finished.

if the trust deed was completed in 2009 I am not sure why they are still chasing ppi??!?!

Am I missing something here??#

I've no idea why they didn't send discharge notification, in fact, until I started a relationship with OH and he told me about the trust deed in May 2012. He didn't even know there should have been a discharge certificate. He got a letter to say he had made his monthly payments for 3 years and to cancel his direct debit. Also have a letter confirming he paid one month too much and they refunded it.

I've asked him to phone many times and ask when they plan to discharge him but they fob him off everytime. I'm tempted to start writing a letter for hi to send, in hope they return a letter with some helpful info or even a date on it.

Your partner is entitled to know.

I don't know if there is a legitimate reason, but if I'd been asking and not getting a straight answer I'd be tempted to put in a formal complaint to the trustee.

To be honest, it all sounds a bit strange (as some other posters on this thread seem to think as well).

I'm going to speak to OH this morning and try not to end up in another argument over it. I only want him to call and ask an approx timescale as to how long it will sort out PPI's and be discharged. I'm not looking for a set in stone date but when I asked the same thing on mon, it ended in an argument. I'm the woman who won't get off the phone till I have an answer, he's the guy who will just 'wait and see'. Ah, bless his cotton socks lol

look up the accountant in bankruptcy register online as it will give dates of the trust deed and discharges etc,you just have to register to use the database but that may help to clear up whether he is discharged or not.

Plasticdaft, we're in Scotland and the only registers i have found only cover England and Wales.
