Well well well.

'Phone call from Halifax this morning. The nice chap there said he spoke to BDO yesterday who told him they had been re-appointed by the court and had in fact cashed the cheque.

Fair enough TDA and I apologise. I'm really angry about this situation though; And if (if) what I was told this morning turns out to be true, it's quite serious. I'm sure you would agree on that.

Well it seems that the answers lodged to the court on my behalf on 9th May - within the required timescale - have not been received, lost or whatever. So on Friday 24th June, unbeknown to me, the approach to re-appoint a trustee to re-open my TD went to a Sheriff unopposed.

Of course, the Sheriff might not sign the orders off but if I were a betting man.....

Ah well. Life goes on. For those in limbo, I hope the upcoming Court of Session case gives you some sort of closure either way. I have mine now.

To be honest, I wish I'd never gone through the whole process. It has re-opened old wounds, caused problems in my married life, and been a constant worry for me. I'm sure others feel the same.

I hope those involved enjoy the fees they receive. And the creditors the pennies.

It was being handled through my claims management company. I signed the letter of authority for their solicitors and I'm waiting to hear from them as to why there was no representation for me in court.

............... and how your documents lodged on your behalf 'got lost'. When were they delivered? By whom? What signature was received?

Hi Firewalker

The document was signed by me to say I would be objecting, and sent back to my claims management company by recorded delivery. They received and sent it onto their solicitors, well within the required timescale. The solicitor had almost 2 weeks to get the answers to court.

It seems to have been between solicitor and court that the problem has arisen. I have no idea what I can do now.

Tinsoldier, official written complaint to bank and financial ombudsman.extrustee has been re appointed, but still need to go to court to have permission to spend money. Also ask td for breakdown of monies.... Who, how much everything. Still keeping fingers crossed for you.
