I have just received a letter from my trust deed company stating they are pursuing claims on my behalf for payment protection ,i assume there is compensation due that they will claim and payback to creditors ? This seems rather strange plus I assume it will prolong the trust deed ?

Welcome to the trust deed forum ayrshire74.

Irrespective of what your trust deed company says, there should be no PPI claim unless you believe the insurance was mis-sold to you.

Do you think that it was?

How far into your trust deed are you?

Hi ayrshire74.

I'd imagine that you will be asked to complete a questionnaire from which the solicitor or claims company will decide whether a claim exists.

If there is a claim (in their view) they put it forwards, the trust deed will not be closed until it is completed, and the proceeds will go to the creditors (minus the claims operators fees, and any referral fee that your trust deed company may or may not be receiving).

As far as we are aware, there are only a couple of trust deed providers pushing their clients into this.

The decision to do so right at the end of a trust deed seems to show a staggering disregard for you, their client. This all could have been started months/years ago to avoid any risk of delay in your trust deed ending.

There was recently a very concerning post in the forum suggesting one such claims operator (connected to a trust deed) pretty much told their "client" how to complete this. I'd suggest that you are entirely honest and straightforward and refuse to be "led" if that happens.

Please let us know how this develops.

Thanks for advice, maybe its me but is this pursuit not slightly crazy. The credit card companies I paid money to as payment protection are now going to get that money back as its classified as an "asset" the mind boggles !

I know... it does seem odd. Perhaps that's why there are only a couple of trust deed companies choosing this route.

Ok latest, I contacted the person "handling" my case he stated that I was sent this letter in error and it would not affect my case. However I have now received 2 phone calls from the company mentioned to pursue ,Equity in Finance, which surprised me.
I phoned my trust deed company no one could speak to me as my case administrator was on holiday......not very professional

I'm sorry to hear that ayrshire74.

Please do let us know how this continues to develop. Hopefully, from what you have been told, it will all go away soon and the trust deed will be closed.
