recieved my letter on the 20th of april reguarding the end of my trustdeed it enclosed the reciept and payments a final claim for remuneration to close a final report on the conduct of the administration a proposed scheme of division and a schedule of creditors claims agreement, i did phone my trustdeed and asked how long it would take for it to be closed and was told not long as you can see that was 2 months ago and yesterday i recieved a letter from them stating that in may 2007 when i signed my trustdeed and it was common knowledge at the time tht ppi could be claimed at that time they have now reviewed my file and now want to make one or more claims for ppi this is a nightmare that just wont go away i phoned and asked how long will this take and was told about 2 to 3 months its been well over 5 years now and its still going on and really in 2007 id nerver heard of ppi claims so really they now want to claim ppi from the creditors take off there fee for doing this then pay them back as part of my estate so it will prob abt xmas before i get my discharge also what id like to no is how can they persue ppi if you wnted to take it out in the first place with loans or c.cards if you said yes to having it how can they claim is this not wrong i no that on one of my c.cards i did agree to it on also on my first mortgage provider

A claim can only be pursued if you were mis-sold the ppi,if you knew about it and wanted it then to allow a claim to be chased would be fraudulent.

Who is the TD with?

Hi sallymilne.

Trust deed firms have been advised by their regulators that they should investigate whether PPI has been missold in case it can help boost returns for the creditors. I don't think anyone saw that coming a few years ago.

You should be asked about the circumstances in which you took out PPI. There are many reasons why it may have been missold, but if it wasn't there should be no claims.

Hi Paul.

There are circumstances in which PPI knowingly purchased by a willing purchaser may still have been missold.

I still havent actually had any contact with slater hayward law who RSM Tenon appointed to investigate any ppi on my accounts,to say that many companies even the good ones are making an absolute hash of this is a massive understatement.

I know what you are saying TDA but as an adult I know whether I wanted and asked for ppi or not,reclaim firms are the new ambulance chasers and its daft because people can do the claiming themselves and not help to fund such an unregulated industry!!!

do the trust deed firms take there cut before it gets paid to the creditors!! if i agreed to the ppi that should be it move on and get my TD closed think over 5 years is long enough now just want my life back my last payment was made nearly 3 months ago was told by email today that my TD would close at my end but the trust deed firm would not close it at their end untill they investigate my ppi claims this could take months

You can be discharged and have your trustee stay in office to clear up any loose ends,thats the situation I am currently in,though I think this is dependant on when the td was signed.

It's good news that you'll be discharged sallymilne.

Just to confirm, trust deed firms feel obligated to investigate PPI due to the instruction they have had from their regulatory bodies. Before that instruction few firms were doing this.

I totally understand the frustration being caused, but if they discharge their client while they get on with this side of things there isn't much else that they can do. The many good firms out there will take no pleasure from the inconvenience that is being caused to some of their clients.
