If a offer of composition is accepted by your creditors , and you enter into an contract of undertakings based on monies to be returned , and then your Trustee informs you , that there is no scope within a deed to do so , and has lied to you , as he has made the same offer for another person , could you sue him for breach of contract ?.

I agreed to take over the mortgage in my sole name , based on money to be returned to me , my Trustee refused to pay out , now I am being harassed by my ex wife who is going to evict me , because I never took over the mortgage , because of my Trustee , I understand that this falls outside normal forum questions , but I think it is a valid point to raise .

He seems very good at hiding behind the law to delay things and keep his fees rolling in. In my case its now a month since he decided he was going to appeal the A in B determination to reduce my fees payable to him....having already taken three months deciding whether to appeal it or not.

Am beginning to wonder how many other "clients" he is holding on to? If you check the A in B register he seems to have a substantial number of trust deeds lasting much much longer than three years.

As for breach of contract unfortunately I have no real idea and like most people in our situation very little way of realisticly funding legal advice or action.

I think your comments are unfair. I absolutely agree with your comments on things with certain firms and if I'm being honest, I think this extends to a majority, not minority.

I had the pleasure of meeting Pinalta on Thursday and in 26 years I think his case is as close to the worst I've ever witnessed. I then speak with tonyd and it appears from both and a bit of research that, in my opinion, this is systematic abuse of the system. However, that said, a lot of us take pride in what we do and continually strive to do the right thing within a system which seems to focus on some and overlook others.

Mark , the pleasure was mine , no matter how desperate my situation I am always willing to help others in any way . Though its a token gesture until I find my feet again . Hope karma gives me forward motion and the truth my shield , along with Justice as my sword .

Not willing to give up now . Protecting my home is paramount . Good thing about the truth is you do not have to remember the lies . Short story from me .......... was raised on a farm and loved milk straight from the cow or goat, or sheep . Was in the kitchen with my great grandmother who was going to make cheese . Was given the task to turn off the heat once the raw milk was coming to a boil , with instructions not to drink the milk . She went to meet the tanker who was collecting the milk and set off up the lane . Mean while I was drinking the milk , she started down the lane , I looked at the milk and said unto god if you fill up the pan , I will never be bad again !!. As she entered the kitchen the pot boiled over , I thought I am saved !! , she remarked oh dear I turned up the heat to high . Be careful what you wish for .
