What happens if i have to give up work due to ill health i have crohns disease and have been missing alot of work,my boss says im unfit for work due to all the time ive had off and all the time off i need for doctor appointments and appointments for blood tests etc.[V]

Following your last question did you find out what your remaining commitment to your trust deed is?

That may influence the answer to this question.

I will contact them today and find out.ive been in and out of hospital the past few months.
I started it in december 2008 so hopefully dont have to long to go now.

Hi Shogun82, sorry to hear of your health problems.
There seems to be different practices out there. I can only advise that if someone cannot pay their trust deed through no fault of their own, my firm would not penalise them in any way. It seems unfair if it is a change of circumstances which you have no control over. I hope it works out for you.

Just tried to phone stirling toner & co but closed for glasgow holiday,will try again tomorrow.
was just worried about being to ill to work and not able to afford my payments,ive never missed a payment since i started and it was november 2008.

Hi, I also tried to phone them today for you. As you know I used to work with them, and I am sure it will not be a problem. Things like this just happen, and it is not your fault. They have a very sensible approach to cases. I have asked them to call you tomorrow.

Found out today i have 19 weeks left to go,Never really got a chance to discuss my ill health as there were only two members of staff in and they were really busy.

Im not sure what they are planning,but the boss made it clear he wasnt happy with all the time off ive had and said i wasnt fit for work,im signed off for two weeks at the moment but the doctors think me working is doing more harm than good,ive collapsed three times this month and had to be taken in to hospital.
If they were to pay me off i would have just paid the rest of the trust deed which is around £800.

This must be a really horrible and difficult situation for you.

In terms of the trust deed I do think that this is likely to work out OK for you though.

Hopefully you'll be able to talk it through properly with someone at your trust deed firm soon.

Sorry to hear that Shogun82,

As a side note - it may be worth talking to your local Citizen's Advice Bureau about the issues surrounding:

a. Employers intended action
b. Whether Crohns, in particular how it is affecting you would be grounds for any application for government assistance through Disability Living Allowance or Incapacity Benefits. Alternatively a Welfare Rights Adviser would be able to assist in this matter.

I do agree with Shona that I wouldnt foresee it being a problem with Stirling Toner.

What do you think would happen if i couldnt pay the £800?Im going to speak to my work and see what happens but i know they want me out after i collapsed at work they wanted me to do 12 hour shifts which i wasnt able to do and they knew it,its like there forcing me out and want me to walk out so they dont have to pay me anything.

I will contact cab today and see what options i have.

Hi shogun82, I also spoke to them today, but they said you didn't mention your illness, just how long you had left to pay . Hope you don't mind but I filled them in on the details. It will not be a problem. As for the £800, you may need to keep that to live on- it can take a while to get any benefit. I have asked them to get Sharon to give you a call.
