I have 2 weeks to go until I find out if my trust deed will be protected. I have spoken to each of my creditors and explained the situation re signing a trust deed and that I cannot make payments and the majority have finally stopped phoning me, or at least at the moment, and just continue sending out standard letters. There is one creditor who is proving very persistent and can be downright intimidating I have now told them on a weekly basis for the last 3 weeks that I signed a TD the date I signed, when it was advertised and who my IP is. They insist I am legally obliged to make payment until the TD is accepted and continually refer to creditors meetings. This week I explained again that paperwork sent out as I got my copy but they insist they have nothing and want me to fax my copy to them, they also said following the call they would note what I had said this week and would hold calls for 7 days and call me again. They wont contact my IP direct and when I asked them to email me to confirm they had not received paperwork said they could not only gave me fax number and asked me to fax to them. I know my IP will have sent the paperwork to them. Do I have to send the paperwork to them, I am reluctant to fax papers like these. What problems could it cause if I dont send them the paperwork as although they have said they have not received them I have told them who my IP is, should they not contact the IP? I dont want to be rude to them on the phone as I feel it is only fair I keep them up to date but each time I have to speak to them I feel really stressed and end up with a sleepless night until I calm down again. I am at the point of just not wanting to speak to them but dont want to do anything that might harm the possibility of my TD becoming protected.

Bear in mind, this is personal for you. The caller is on a shift and someone else will be in their seat tomorrow with a list which may or may not have your account on it. They don't know you and are not personally affected by the outcome of your call. You mught find it helps to have a few prepared responses/questions so that being anxious doesnt leave you flustered on a call. Along the lines of...' I have given this information before, I need to record all calls for my records. Please give me your name and which department/company/branch you're calling from.' Then give your trustee/IP updates so they know which companies and can check they actually were notified.

Hi worriedmary.

If there is no legal action there is little to worry about.

Your trustee will have sent out paperwork which is probably with their agents. It's not your fault that they aren't communicating with their own agent.

You must do whatever you're comfortable with, but I'd politely refuse to discuss the matter with them at all and direct them to you trustee. If they will not liase with your trust deed firm after you have authorised them to it's really not your problem.

When I was waiting for my TD to become protected I also received phone calls demanding payment. I started carrying around my IPs company phone number as I found as soon as I offered an alternative number I began receiving fewer calls, as it dawned on them I was only going to refer them to my IP.

Stick to your guns and do nothing other than refer them to your ip. Its hard when they bombard you with calls,for us egg were a nightmare!!!

Hi worriedmary, it is very hard receiving phonecalls from creditors they can be persistant and most of the people on the other end have no idea really what a TD is. I used to just tell them I had signed a TD and that to keep phoning me was harrasment. Any letters I got I forwarded to my IP straight away, must admit my IP was good as within two weeks after signing TD (and before it became protected) I stopped receiving phonecalls and letters.

Good luck and I hope your TD becomes protected. You have made your first step to becoming debt free and have light at the end of the tunnel.

Who is the creditor? Maybe they're one of the more persistant ones. Just keep referring them to your trustee. The calls will stop and it'll get better. Other than waiting for discharge, I found the first few months the most stressful with the phonecalls and letters. It does get better. Ignore your phone if possible and only answer to numbers of people you want to talk to. Your creditors will probably sell on your debt and you may get debt recovery firms phoning you. Ignore them, there's nothing they can do to you.

It took almost 6 months for Santander and MBNA to give up on calling me. Max Recovery were about the same but that's after they bought one of my debts. It gets second nature to say 'I'm now in a protected trust deed. Please contact this number for further information with regards to your call'. Just keep remembering, it gets better and the 36 months will be up before you know.

Nothing left to discharge - everything's done and dusted!

Hang on in there been through the same , remember one day and one phone call more is really one less until your deed comes protected .[;)]

many thanks for all your responses it has helped to give me the support I need as I wait until the end of the 5 weeks. I value greatly the fact that I can come on here and raise a query or express my concerns in the knowledge that I will be speaking to the experts and people who have been in the same position as I am now and have got through it. I do feel much better now than right at the start of the process and more positive about the future, its not long now I am just counting down the days, first payment goes tomorrow so hopefully it is the first of 36 followed by a fresh start.
