Can the d w p deduct payments from my state pension even though my debt to them is included in my protected trust deed?

Are they deducting money from your state pension at the moment?

I contacted my trust deed adm ins regarding this issue over a month ago when the d w p contacted me to inform that this what they intended they of course didnt do anything as per usual i have absolutely no confidence in the administrators whats the point in me keeping to my side of the contract if creditors can do this

It arose through tax credit overpayments

Hi gavriel,

This probably isn't the answer you're hoping for, but you probably need the assistance of your trustee to look into this and resolve it for you (if that is possible).

You should chase them up to confirm what the situation currently is and what they've done about it so far.

i have contacted them on three separate occasions as per usual they never get back to me they were supposed to be sending it to the creditor hassle team! i am so hacked off with this i have been in this trust deed for over two years and never missed a payment what is the point of a "protected trust deed " if my creditors can do this or is the d w p a special case? i have absolutely no confidence in this company

Hi gavriel.

The DWP is in a slightly different position partly because they have the means to recover these funds from you (via your pension) in a way that no credit card provider, for example, could.

The question is of course whether they should be doing this, and unfortunately I think you're going to have to rely on your trust deed provider to investigate and determine that.

One of the reasons I ultimately addressed my debt juggling was a redundancy. I just couldn't continue. When I was receiving job seekers allowance HMRC screwed up my tax. ( you get taxed on benifits !! Who knew?) I received postal notification when they got round to chasing me for it. I phoned them to actually query it ( I didn't know benifit was taxed) and by this time I was in the Trust deed.. The tax due was part of my debt. Obviously different department but possibly similar rules?

Sorry meant to add they told me just to forget the payment and it never affected my pension.

I contacted d w p who told they never ask to be included in disbursement from dept management company's! Even though I am paying an amount each month to credit fix for the d w p? Why if this is the case did credit fix accept d w p as part of my trust deed, also where does the "protected" part come in incidently no contact from credit fix at this date " no surprise there!feeling very frustrated to say the least

I'm slightly confused, Gavriel - tax credits are dealt with by HMRC, not by DWP. Is it some other type of overpayment instead?

Also, did the overpayment definitely start and finish prior to your Trust Deed being signed?

Hi Kevin my pension is paid by the d w p so I assume they are taking the payments on behalf of h m r c ? No communication from credit fix! So am only assuming, I can confirm that the overpayment was prior to trust deed otherwise I couldn't have included it
