Hi on entering a trust deed the trustee had requested a valuation of my works pension and have requested I repaly 1300 from my pension to the trust deed. But on reading advice on the internet it would seem that money that is already paid to a pension fund is not available to the creditiors, but I do not know if this is the case and if I can dispute them claiming against it. I obviously do not have access to my pension funds so is resulting in my trust deed being extended t repay the 1300.

Did they suggest that this would be the case when you signed the trust deed, kerr64?

There was a recent judgement down south in a bankruptcy case agreeing that the funds which were available to be withdrawn from the person's pension fund could be requested by the trustee. However, this was quite controversial and does not necessarily translate to your situation.

To be honest I don't know it was all such a haze at the time and the request came some months after.

Hello kerr64.

This seems quite unusual.

Could you ask your trustee why your pension is being looked at in this way and tell us the answer provided please? It may help us to help you.
