Hello
I am now in position to make a to make around £1,000 per month to a payment plan but my T/D company will not come up with a fixed sum that this go to & are preferring to force the sale of my house
my total debit was £39,000 3 and a half years ago can i not insist on an arrangement being entered into

Why do you think they're looking to sell the home rather than accept £1000 per month?

Hi Roy,

How long have you been in your Trust Deed and what was the agreement made at the start in respect of how the equity in your property would be dealt with?

Forcing the sale of someone's how is always a last resort for any Trustee but unfortunately it can happen if a solution that works for all parties involved cannot be reached.

David, 3 years 10 months it states 3 years on the contract the equity on my house was never mentioned

The company i signed my T/D with passed me onto another company within 2-3 months of signing

Hi Roy,

Thanks for this information.

It's unusual for the equity and a property not to be discussed at all as it's the most important part in a Trust Deed.

Have you requested a copy of the paperwork which you signed at the start of your Trust Deed? This should show you what the agreement was and how your property would be dealt with in the Trust Deed.

A couple more questions for you if that's ok:

1 ÔÇô How much were you paying per month/how much have you paid to date to your Trust Deed?

2 - How much equity is your Trustee saying your property has?

3 ÔÇô Do you jointly own the property with anyone or have any children living in the property?
