Payment of trust deed

I have paid 36 months towards my trust deed and received a letter telling me that I am now due ?ú2600 because of my increase in wages. I notified the company in April and May of my new salary and even sent in my payslip. My monthly payments of ?ú350 did not increase as I was led to beleive they would. I am now expected to pay ?ú515 per month (last payment due on 01st July. My monthly pay is ?ú1000 and ?ú130 to ?ú150 mileage costs (clearly noted on payslips). My direct debits amount to ?ú280 and my private diesel costs are about ?ú60 per month. This will leave me with about ?ú250 per month to live off. I have had to pull out of a rent agreement for accommodation as I am now unable to pay the rent (currently living in a tied house). Why has this happened, can I offer to pay the outstanding amount in a one off payment or do I just have to manage with what they have stated (even though this outstanding amount has been a result of them not acting on my notification of increased income). This is causing me much upset and am now not sleeping (again) as a result of worrying about this. Any advice is much appreciated.

Hello custard01 and welcome to the forum.

It would be normal for your Scottish Trust Deed payment to increase after a salary increase. However it does seem strange that the notification of the increased amount has been left so late, especially after you so proactively and honestly let the company know about the increase last year.

How much was the increase in your salary?

You've mentioned the possibility of making a one-off payment. I'm sure this would be acceptable; do you have access to the money to be able to do so?

Hi Custard

I thnk at the 1st instance you should write advising that you have been up front and provided every information on earnings and have concerns that they have not addressed matters in the appropriate period of the Trust Deed and advised you of any increase. I would also express concerns that they are trying to retrospectively collect money.

Thank you for replying. Unfortunately I don't have the money to pay the "arrears" off in full, however, if they insist that I have to pay this money to them I will try my hardest to raise the money and be done with the whole thing.

I have sent a letter to Wilson Andrews contesting the arrears because when i actually checked my information they were informed of my new salary on my first day in the job (13th April 09) and I also faxed a copy of my payslip at the end of April high lighting my actual annual salary and my monthly pay. I also contacted my case administrator in May asking her to adjust my contribution and was told that it would be dealt with. Then in June I received the standard request for the six monthly update which I sent off all my payslips from December 08 to June 09 which again would have high lighted the increase in earnings.

My increase in salary was quite significant - ?ú15477 to ?ú20000 per annum and I was fully aware that my contribution would also increase hence the reason for contacting them.

Basically I am contesting on the grounds that they were notified 3 times of my increased earnings and did not act upon the information given to them at the time. I am not hopeful that they will reduce or accept fault however, I'm so desperate that I had to try. I also requested that they return by payslips from Dec 08 to Jun 09 as these have never been returned to me either!

Any further advice would be very much appreciated and thank you.

Hello custard01,

It sounds as though you have followed Mark's advice which I'm sure is the right thing to do. At the moment I guess it's a question of waiting for the response from your Trustee.

I hope you also asked in writing for the payslips back? It's a pretty basic and reasonable request and I cannot see why the Trust Deed firm would not comply.
