I was wondering if a payment break can be granted for one month from a trust deed. the trust deed will be finished early 2010 and generally need a payment break. my partner lost her job in may and hasnt been able so far to gain new employment and this has put extra strain on me to pay. we do not get council tax or rent benefit and also my partner has now exhausted her jobseeker conts and doesnt get anything from this. the trust deed is just in my name as are the debts would a payment break be available in this situation.

Hello Robert0000,

Welcome to the Scottish Trust Deed forum.

This is really a matter for you to liase with your Trustee; there is no right or wrong answer. Given that you are so far through the Trust Deed and given that there are clear supporting circumstances I'd be disappointed and surprised if the answer was "no".

If the answer is "yes" you will normally need to make additional payments to complete the Trust Deed.

Please let us know how you get on.

Hi Robert0000

Trust Deed Assistant is correct. Best advise the Trustee of the position and request a break.

I would be surprised if there was any problem.

I'm very glad to hear that common sense has prevailed.
