Partner buying a house

Hi,

I entered into a trust deed back in October 2016.

I have recently found out I am expecting and following this news, my partner wants to buy a property for us to live in.

It has been suggested that I add onto this and we potentially enter into a mortgage with a guarantor as we could afford the house which would suit us best but I am concerned that this would not be accepted and could actually negatively affect my partner.

Please could you give me some advice about what would be best to do in this situation or what I could actually do?

In terms of the trust deed, if you acquire any assets during the 4-year period, it is conveyed to the trustee and this may cause the problem. If a property is purchased and you are listed on the title deeds, then this may cause a problem. The trustee may also have to grant permission for you to grant a security.

If you become financially associated with your partner, then it is possible that notification of your trust deed will appear on their credit report.

I would recommend proceeding with this once you have been discharged or seek advice from your trustee.

I think there is every chance that adding your name could just cause problems. Perhaps best left until you are out of your Trust Deed?

Hi igall,

Congratulations on your lovely news! Exciting times ahead and hopefully not too many sleepless nights.

As the others have said the easiest thing might be for your partner to purchase the house in their name and then once your Trust Deed is completed and you are discharged you could look to be added to the mortgage.

When my partner and I bought our house they didn’t have a good credit rating so the house went in my name initially. Years later when we re-mortgaged and my partner had a better credit rating we applied for a joint mortgage and the house went into joint names so it can be done.

I’d also suggest reaching out to your Trustee at some point to let them know that your financial circumstances and income may change and to go over a review of this.
