owed extra payments from RSM TENON

I had posted a few days ago about my friend who paid too many standing orders during and after her trust deed. It turns out she paid 47 standing orders instead of 36.

The only problem is it was paid to a company formerly known as RSM TENON. The company has been taken over by APEX DEBT solutions and they so far have not replied to emails regarding the over payments.

It works out she paid ยฃ1600 over what she should have because she thought they would tell her the trust deed had finished.

She needs help if anyone knows what she can do to reclaim what she is owed.

Hi lee1974.

Your friend is going to need to work this out directly with Apex Debt Solutions.

There's a phone number on their website at ApexDebtSolutions.co.uk

Her trustee (or former trustee) will not want to be sitting on funds that aren't due to her trust deed.

Hi Lee1974,

As TDA said it's something that your friend really needs to speak with the Trustee about.

Where any overpayment has been paid to us we will always look to get this refunded back out to the client.

With all of the recent changes at RSM Tenon and transfer to APEX it may just take a little longer to receive a reply by email. Tell your friend to keep on at them and hopefully it's resolved.

A question for one of our experts...

What would happen if a client continued making payments after their trust deed had ended and you were no longer able to contact them (moved house, telephone number changed etc)?

Would the money be passed to the AIB?

I don't think that the creditors would be entitled to this money as it wouldn't be part of the agreement under the Trust Deed.

On that basis I would consign it to the Accountant in Bankruptcy and should the debtor make contact we could direct them to the AIB for the funds.

Potentially... If the debtor was making electronic payments via their own bank account we could pay the overpayment directly into their bank account.

Like David said creditors can't make a claim. We would attempt to contact their bank and see if they can trace. Then refund money in gathered.
Keep contacting Apex and i'm sure it will all get sorted eventually.
