I am currently living overseas, I understand I must reside in Scotland to qualify for a protected trust deed, is this the case? Would I need to come back to qualify, and remain in Scotland for the duration?
I am originally from Scotland and left early this year.
Thank you davied.
Could you let us know which month you left?
Do you retain a home in Scotland?
It was quite a while ago, but I seem to remember our experts saying this might be OK if the departure wasn't too long ago. Hopefully one of them can confirm the answer for you soon.
I left in January and still have property in Scotland.
I found the answer on another thread, because I have lived in Scotland within last 12 months I can apply.
Edit to add solution
Jurisdiction per the act states that the person needs to have been resident in Scotland at the relevant time. ÔÇ£the relevant timeÔÇØ is defined as any time in the year immediately preceding the date of presentation of a petition for Sequestration and therefore would be any time in the year at the date of signing of a Trust Deed.
