Old Loan

Even though ive completed my Trust Deed and discharged 18 months ago, i keep getting a loan arrears letter sent every 6 months stating that this is still outstanding, which is growing rather rapidly with every letter i receive. Surely this should have been settled by my Trust Deed administrator? also why are they accruing interest on a Debt they know has been accepted via a Trust Deed?

Hi Rickie1.

If that debt existed when your trust deed began then it's no longer enforceable.

They can write to you saying it's due to be paid and they can pretend that interest is being added - but they're only kidding themselves.

It looks like they haven't updated their records to confirm the completion of your trust deed.

You could ignore them, or you could contact them an explain the situation and request that they update their files.

I doubt there is any motive behind these letters, Rickie1 - sounds to me that for some reason they have not updated their system regarding the trust deed and these letters are therefore being automatically generated.

If you call them and get a human involved then they should put a stop to it.

Ive since found out from the company that is dealing with my TD, that due to an Audit, the creditors are still awaiting their allocation of the TD. Apparently the Audit is complete, so hopefully all will receive what they are due and these letters will cease once and for all.
