old bank account

I have a slightly complicated query, I entered into a protected trust deed in may 2010. My old bank account was with bank of scotland and until recently the balance was in the red as the overdraft amount was included in the trust deed. My employers have just paid my husbands wages into this account (an oversight, he only does occassional work for the company and hadnt done any since I closed or thought I had closed, the account) I have a payslip proving the money is my husbands wages and have asked my employers for a letter stating the money is his and not mine (he has nothing to do with the trust deed). Will bank of scotland give me the money back? or does anyone have any better ideas? I am desperate this wage is bread and butter money for us this month as my husband has been temporarily laid of from his regular job due to the weather. Help!

Hi cheerykell

don't worry, if it was paid in after and you can prove it was your husbands, it wi be returned.

My advice wod be to get your Trustee to fax the bank to release the funds. This normally works as they have no right of set off.

Just to let you know I got the money today with no problems, my trustee sent me a letter to take to the bank by fax within 2 hours of first enquiry(this is the first time I ever had to contact them). I felt the service was excellent and not the nightmare I anticipated, my trust deed company is Carrington Dean in Glasgow.
